Nuse, P.E. <br />City Manager <br />City of San Marcos <br />630 East Hopkins <br />San Marcos, Texas 78666 <br />Dear Mr. Nuse: <br />This letter addresses cultural resources compliance under Section 404 of the Clean <br />Water Act associated with a proposal by the City of San Marcos (COSM), Hayes <br />County, Texas to construct the Rio Vista storm water drain and outfall structure. The <br />drainage and outfall improvements will involve unavoidable adverse impacts to the <br />eligible National Register of Historic Places (NRHP) prehistoric site, 41 HY261. This <br />project has been assigned Project Number SWF 2011 - 00304. Please include this <br />number in all future correspondence concerning this project. <br />The enclosed signed Memorandum of Agreement (MOA) addresses the adverse <br />effects to the 41 HY261 and was negotiated and signed in consultation between the U.S <br />Army Corps of Engineers (USACE) and the Texas State Historic Preservation Office <br />(SHPO). Your office of the COSM and Texas State University, each signed as invited <br />signatories. <br />Thank you for your assistance in completing this document.
