0 87 tf- """" - - () c-4 ORDINANCE 1990- 44 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AHENDING CITY WATER CONSERVATION REGULATIONS PERTAINING TO THE TIME PERIOD FOR USE OF AUTOMATIC SPRINKLER SYSTEMS; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1: That subdivision (1) of subsection (a) of Section 30-10 of the San Marcos Code of Ordinances is hereby amended to read as follows: (1) Grass, trees or plants may be watered only using the following methods and during the respective times indicated: (A) With an automatic sprinkler system, between midnight and 6:00 a.m.; or (B) With any other watering means, between 7:00 p.m. and 10:00 a.m. SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. A person who knowingly or intentionally violates any provision of this ordinance during a time when Stage 3 (Water Warning) of the San Marcos Water Conservation Plan is in effect shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than $50.00 nor more than $200.00. A person who knowingly or intentionally violates any provision of this ordinance during a time when Stage 4 (Mandatory Conservation) of the San Marcos Water Conservation Plan is in effect shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than $50.00 nor more than $500.00. Each day upon which a violation occurs or continues shall be deemed to constitute a separate offense. SECTION 5. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos.
