<br />0 87 <br />tf- <br />"""" <br />- <br />- <br />() <br />c-4 ORDINANCE 1990- 44 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AHENDING CITY WATER CONSERVATION <br />REGULATIONS PERTAINING TO THE TIME PERIOD FOR USE OF <br />AUTOMATIC SPRINKLER SYSTEMS; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; <br />PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; <br />DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1: That subdivision (1) of subsection (a) of Section <br />30-10 of the San Marcos Code of Ordinances is hereby amended to read as <br />follows: <br /> <br />(1) Grass, trees or plants may be watered only using the <br />following methods and during the respective times indicated: <br /> <br />(A) With an automatic sprinkler system, between midnight and <br />6:00 a.m.; or <br /> <br />(B) With any other watering means, between 7:00 p.m. and <br />10:00 a.m. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining provisions <br />of this ordinance shall remain in effect as if the unconstitutional <br />or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances or parts of ordinances in conflict <br />herewith are hereby repealed. <br /> <br />SECTION 4. A person who knowingly or intentionally violates any <br />provision of this ordinance during a time when Stage 3 (Water Warning) <br />of the San Marcos Water Conservation Plan is in effect shall be deemed <br />guilty of a misdemeanor and upon conviction shall be punished by a fine <br />of not less than $50.00 nor more than $200.00. A person who knowingly <br />or intentionally violates any provision of this ordinance during a time <br />when Stage 4 (Mandatory Conservation) of the San Marcos Water <br />Conservation Plan is in effect shall be deemed guilty of a misdemeanor <br />and upon conviction shall be punished by a fine of not less than $50.00 <br />nor more than $500.00. Each day upon which a violation occurs or <br />continues shall be deemed to constitute a separate offense. <br /> <br />SECTION 5. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper of general <br />circulation within the City as provided by the City Charter of the <br />City of San Marcos. <br /> <br />PASSED.
