<br />Q <br />£:> 0- 88 <br />0- 0- <br />0'" -- <br />-... c <br />("A r.J <br />~ =- OPDINJ\I'1CE lqq()- 45 <br /> <br />'E <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 5-BUILDINGS AND <br />BUILDING REGULATIONS OF THE SAN MARCOS CODE OF ORDINANCES <br />~ TO ADD SECTION 5-128(d) AUTHORIZING MASONRY PAVING UNITS <br />~I FOR USE IN OFF-STREET PARKING LOT PAVEMENT CONSTRUCTION; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1: That Section 5-128 of Chapter 5- Buildings and <br />Building Regulations of the San Marcos Code of Ordinances is amended to <br />add a subsection (d) to read as follows: <br /> <br />Sec. 5-128. All-weather surface. <br /> <br />(d) Masonry paving units. Pervious or impervious masonry <br />paving units shall be installed and maintained <br />according to the manufacturer's recommendations for the <br />anticipated traffic load. Masonry paving units shall not be <br />used without obtaining a permit from the Building Official based <br />upon review of construction plans and specifications; <br />provided, that no separate permit for the use of masonry paving <br />units shall be required when such use is in connection with a <br />building permit for construction activity on the same lot. <br /> <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisqiction, the remaining provisions <br />of this ordinance shall remain in effect as if the unconstitutional <br />or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances or parts of ordinances in conflict <br />herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon conviction <br />shall be subject to the penalty provided in Section 1-5 of the San <br />Marcos Code of Ordinances. <br /> <br />SECTION 5. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading May 29, 1990. <br /> <br />PASSED AND APPROVED on second reading June II, 1990. <br /> <br />PASSED AND APPROVED AND ADOPTED Jun 90.'
