<br /> 48 <br /> Special Meeting November 7, 1983 Page 4 <br /> Mr. Brown moved to amend Section 4. of the Ordinance to include the <br /> following language: . . . newspaper of general circulation in the <br /> area; "and upon such effective date, the Ordinance of the City <br /> Council which established a temporary moratorium on the receipt of <br /> applications for building permits which include plumbing within the <br /> corporate limits of the City of San Marcos shall be immediately and <br /> automatically rescinded." Ms. Kissler seconded the motion, which <br /> passed unanimously. <br /> Mayor Craddock moved that throughout the Ordinance where the terminology <br /> "developer" and "he" are used, that the Ordinance be amended to read <br /> "party" in place of developer and he, and Mr. Farr seconded the motion, <br /> which passed unanimously. <br /> Mr. Farr moved to amend the Ordinance to include in Section 30-49, Sec- <br /> tion 2 in the first sentence the following language: . . . single de- <br /> tached dwelling unit development, "with development to be considered <br /> under this Ordinance to be a land area for planned construction of <br /> more than one single family dwelling unit," . . . . Mr. Guerra second- <br /> ed the motion. The entire sentence with the amendment was read into <br /> the record, and then the Council voted unanimous approval of the amend- <br /> men t. <br /> City Manager Gonzalez stated the Freese and Nichols' report dated <br /> November 7, 1983, more than substantiated the $750 as a low figure. <br /> Ms. Kissler stated she would like to see this Ordinance come back be- <br /> fore the Council in 6 or 12 months to see what the impact has been and <br /> to review the $750 fee. She directed that close accounting records be <br /> maintained. Jim Byrn stated he thought the fee needed to be based on <br /> realistic information, that good firm values need to be used. <br /> Mayor Craddock then moved to amend the Ordinance to change the capital <br /> recovery fee = $750/LUE to "$900/LUE" (Thi s appears in Section 30-44). <br /> Mr. Brown seconded the motion, which passed unanimously. City Manager <br /> Gonzalez stated it was the Staff's standpoint that benefits would be <br /> derived by having the reservation up front. <br /> The Council then voted unanimous approval of adoption of the Ordinance <br /> on third and final reading, as amended. <br /> Mayor Craddock introduced for consideration approval of an Ordinance <br /> on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND <br /> CONTAINING 121. 43 ACRES, MORE OR LESS, OF LAND OUT OF <br /> THE J. M. VERAMENDI SURVEY NO. 1, A-17, IN HAYS COUNTY, <br /> TEXAS, SAID LAND BEING LOCATED WITHIN THE EXTRATERRI- <br /> TORIAL JURISDICTION OF SAID CITY AND LYING ADJACENT TO <br /> PRESENT CITY BOUNDARIES; APPROVING A SERVICE PLAN FOR <br /> SAID TRACT; EXTENDING THE BOUNDARY LIMITS OF SAID CITY <br /> SO AS TO INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS <br /> OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER <br /> CITIZENS OF SAID CITY; BINDING SAID INHABITANTS BY ALL <br /> OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF <br /> SAID CITY AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Farr moved to approve the Ordinance on second reading and Mr. <br /> Guerra seconded the motion, which passed unanimously. <br />
