<br /> 68 <br /> LICENSE AGREEMENT TO MAINTAIN IMPROVEMENTS <br /> IN RIGHT OF WAY <br /> THIS AGREEMENT made this 14th day of Auqust , between <br /> the CITY OF SAN MARCOS, TEXAS, hereinafter called "Licensor", and THE <br /> HOUSING AUTHORITY OF THE CITY OF SAN MARCOS, hereinafter called <br /> "Licensee". <br /> WITNESSETH: <br /> ARTICLE I. <br /> 1. Term: This agreement shall take effect the date hereof, and <br /> unless sooner terminated as provided herein, shall continue in force so <br /> long as the property covered by this agreement is used for the <br /> purposes herein set out, not to exceed a period of fifteen OS) years. <br /> This agreement shall be subject to renewal for a similar period by <br /> mutual agreement of the parties. <br /> 2. Consideration and Description: In consideration of the <br /> Licensee's performance of the covenants as hereinafter set forth, <br /> Licensor hereby grants a license and permission to Licensee to <br /> construct, use and maintain the parking and landscaping improvements as <br /> shown on the attached Exhibit A (the "Improvements") within the <br /> Licensor's right-of-way in the 200 Block of Love Street in the City of <br /> San ~1arcos, Hays County, Texas. <br /> ARTICLE II. <br /> Licensee undertakes and agrees: <br /> 1. Specifications: To construct the Improvements as shown on <br /> the attached Exhibit A in conformance with all City of San Marcos <br /> regulations and ordinances. <br />
