<br /> -2- <br /> SECTION 3: That Section 37-18 of the San ~1arcos Code of <br /> Ordinances is hereby amended to read as follows: <br /> Section 37-18. Additional Requlations For Sexual Encounter <br /> Centers. <br /> (a) Sexual encounter centers shall not contain a bed, sofa, or <br /> mattress in any room on the premises, except that a sofa <br /> may be placed in a reception room open to the public. <br /> ( b) Sexual encounter centers shall have a manager's station <br /> which affords an unobstructed view of every area of the <br /> premi ses to which any patron is permitted access for any <br /> purpose, excluding restrooms. <br /> SECTION 4~ That subsection (c) of Section 37-4 of the San Marcos <br /> Code of Ordinances is hereby amended to read as follows: <br /> . . . <br /> (c) The applicant must be qualified according to the provisions <br /> of this Chapter and the premises must be inspected and found <br /> to be in compliance with various laws enforced by the <br /> city/county health department, San Marcos Fire Department, <br /> and the city's building official. All inspections shall be <br /> completed within thirty ( 30) days of the filing of the <br /> application. <br /> SECTION 5. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisqiction, the remaining provisions <br /> of this ordinance shall remain in effect as if the unconstitutional <br /> or invalid portion had not been adopted. <br /> SECTION 6. That all ordinances or parts of ordinances in conflict <br /> herewith are hereby repealed. <br /> SECTION 7. That any person violating any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor and upon conviction <br /> shall be subject to the penalty provided in Section 1-5 of the San <br /> Marcos Code of Ordinances. <br /> SECTION 6. That this Ordinance shall be in effect ten (10) days <br /> from and after its passage, and it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the City <br /> of San Marcos, Texas. Sexually oriented businesses in existence on the <br /> date this chapter becomes effective shall make application to the Chief <br /> of Police for a license under Section 37-4 of the San Marcos Code of <br /> Ordinances within sixty (60) days of that date. <br /> PASSED AND APPROVED on first reading July 23, 1990. <br /> PASSED AND APPROVED on second reading August 13, 1990. <br /> PASSED AND APPROVED AND ADOPTED ~ gust 27'19~O. . <br /> K t .
