<br />-R- <br /> <br /> <br />(b) The financial disclosure statement file maintained by the <br />city secretary under this section shall be kept in alphabetical <br />order for each year in which statements are filed. This file <br />shall be open to public inspection during normal hours. The <br />city secretary shall maintain a list of all persons requesting <br />to inspect such files identifying the file or files inspected. <br /> <br />Sec. 2-85. Forms for statements. <br /> <br />Financial disclosure statements shall be filed on the form <br />promulgated by the city secretary. The city secretary shall <br />provide a form to any person requesting one and, not less <br />than ten (10) days before the last day set for filing a <br />statement by any person, shall send a form to the person. <br /> <br /> <br />DIVISION 3. ETHICS REVIEW COMMISSION <br /> <br />Sec. 2-91. Established; composition; term of members. <br /> <br />An ethics review commission is hereby established, to be <br />composed of seven (7) members all of whom shall reside in the <br />City of San Marcos. The commission members shall receive no <br />salary, compensation or remuneration for their services on the <br />commission. Each member of the commission shall serve for a <br />term of two (2) years or until a successor is appointed. The <br />terms shall be staggered, so that the terms of four (4) <br />members shall expire in June of odd-numbered years and the <br />terms of the other three (3) members shall expire in <br />even-numbered years. <br /> <br /> <br />Sec. 2-92. Organization. <br /> <br />The ethics review commission each year shall elect from its <br />membership its chairperson and upon its formation shall <br />promulgate its own rules and regulations as to its forms and <br />procedures and maintain proper records of its opinions and <br />proceedings. <br /> <br /> <br />Sec. 2-93. Authority and duties. <br /> <br />The ethics review commission shall act as authorized by <br />section 12.02 of the Charter of the City of San Marcos <br />concerning conflicts of interest, ethical conduct or interests <br />of city officials and employees. <br /> <br />(a) The commission shall meet at least once a year to review <br />this article and may make recommendations to the city <br />council. <br /> <br />(b) The commission shall conduct hearings into allegations <br />of violations of this article. <br /> <br />(1) Any allegation by any citizen, public official or <br />employee that a person has violated the code may <br />be referred to any member of the commission. <br /> <br />(2) A commission member receiving an allegation pursuant <br />to subsection (b) may request the commission to <br />convene to review the allegation. <br /> <br />(3) The commission shall recommend to appropriate <br />authorities Cases for prosecution. <br />
