<br /> 97 <br /> SITE ASSESSMENT SERVICES AGREEMENT <br /> STATE OF TEXAS <br /> KNOW ALL PERSONS BY THESE PRESENTS: <br /> COUNTY OF HAYS <br /> 1. PARTIES: The City of San Marcos, a Texas municipal <br /> corporation (the City); and Texas Industrial Waste Control, Inc., a <br /> Texas corporation (TIWC). <br /> 2. PROPERTY: A 4.875 acre tract of property depicted on the map <br /> attached hereto as Exhibit A. <br /> 3. PROJECT SUMMARY: TIWC will perform a comprehensive Level 3 <br /> Site Assessment to scope the environmental liability, if any, of the <br /> Property. <br /> TIWC has performed a "Walk Through" which demonstrated past use of <br /> the property as an Underground Storage Tank site; thereby warranting a <br /> comprehensive Level 3 Site Assessment. <br /> This comprehensive assessment will include drilling, sampling, <br /> testing, and research on property use. The proposed research will <br /> involve conducting interviews with available persons who might have <br /> knowledge of past uses of this property and/or environmental problems <br /> relating to it. <br /> 4. SCOPE OF WORK: The scope of work is outlined in the attached <br /> table labelled Level 3 Site Assessment. <br /> 5. COSTS: The work will be performed on a time and materials <br /> basis with a "not to exceed" cost to the City of $5208. Additional <br />
