<br />110 <br />c::> <br />\:;- <br />"'...... <br />'- <br />if) <br /> <br />~ <br />~»J <br /> <br /> <br />ORDINANCE 1990- 65 <br /> <br />AN ORDINANCE OF THE CITY COUl~CIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 26 OF THE SAN <br />MARCOS CODE OF ORDINANCES BY ADDING SECTION 26-4 <br />DESIGNATING THE HAYS COUNTY TAX ASSESSOR-COLLECTOR <br />AS THE TAX ASSESSOR-COLLECTOR FOR THE CITY; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; <br />DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City desires to contract with Hays County for the <br />collection of City property taxes by the Hays County Tax Assessor- <br />Collector, under authority of sections 6.23, 6.24 and 6.30 of the <br />Texas Property Tax Code and Art. 4413 (32c), V.T.C.S.; and, <br />WHEREAS, the City makes a designation of the Hays County Tax <br />Assessor-Collector as its Tax Assessor-Collector pursuant to <br />section 6.22 (b) of the Texas Property Tax Code, in order to <br />facilitate the tax assessment and collection agreement with the <br />County; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 26-4 of the San Marcos Code of <br />Ordinances is hereby added to read as follows: <br /> <br />Sec. 26-4. Desiqnation of tax assessor-collector. <br /> <br />For the purpose of facilitating an agreement between <br />the city and Hays County for the assessment and <br />collection of city property taxes, the Hays County Tax <br />Assessor-Collector is hereby designated as the tax <br />assessor-collector for the City. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances or parts of ordinances in <br />conflict herewith are hereby repealed. <br /> <br />SECTION 4. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions <br />of the Charter requiring that ordinances shall be presented at <br />three separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date <br />of its final passage be suspended, and these provisions are hereby <br />suspended, and this Ordinance shall take effect and be in full <br />force and effect from and after its adoption and after its <br />publication in a newspaper of general circulation within the City <br />as provided by the City Charter of the City of San Marcos. <br /> <br />0 s~ro~r,> 1990, <br /> <br />0 r1l'L(}11}AJJ <br />?9:~ «. {jý'~ <br /> <br />Janis K.
