<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND
<br />CONTAINING 5Ø.158 ACRES, MORE OR LESS, FRONTING ON
<br />THE SOUTHEAST RIGHT-OF-WAY LINE OF INTERSTAirE
<br />HIGm'lAY 35 AT ITS INTERSECTION WITH CENTER POINT
<br />ROAD IN HAYS COUNTY, TEXAS, THIS LAND BEING LOCATED
<br />WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE
<br />CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES:
<br />APPROVING A SERVICE PLAN FOR THIS TRACT: EXTENDING
<br />THE BOUNDARY LIMITS OF THE CITY SO AS TO INCLUDE
<br />THIS TRACT: GRANTING TO THE INHABITAN'rS OF THIS
<br />TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER
<br />CITIZENS OF THE CITY: BINDING THE INHABITANTS BY
<br />ALL OF THE ACTS AND ORDINANCES, RULES AND
<br />REGULATIONS OF THE CITY: AND DECLARING AN EFFECTIVE
<br />DATE.

<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />provided an opportunity for all interested persons to be heard at two
<br />(2) public hearings, held once on August 24, 1990 , and
<br />once on August 27, 1990 , to consider the proposed
<br />annexation by the City of San Marcos, Texas of 5Ø.158 acres, more or
<br />less, of land fronting on the southeast right-of-way line of
<br />Interstate High\.¡ay 35 at its intersection with Center Point Road, Hays
<br />County, Texas, and being more particularly described by metes and
<br />bounds in attached Exhibit A: and,
<br />
<br />WHEREAS, an on-site public hearing has not been requested in
<br />writing by more than 2Ø adults residing in this area: and,
<br />
<br />WHEREAS, notices of these public hearings were published in the
<br />San Marcos Daily Record, a newspaper having general circulation in the
<br />City and in the territary proposed for annexation,
<br />on August 12, 1990 , and August 16, 1990 , these dates
<br />being not more than twenty (2Ø) days nor less than ten (lØ) days prior
<br />to the hearings for which notices were given: and,
<br />
<br />WHEREAS, prior to the publication of notices of these hearings,
<br />the City Council of the City of San Marcos, Texas directed preparation
<br />of a service plan that provides for the extension of municipal
<br />services to the area proposed for annexation: and,
<br />
<br />WHEREAS, the proposed service plan was made available for
<br />inspec"tion and explained to the inhabitants of the area to be annexed
<br />at the public hearings: and,
<br />
<br />WHEREAS, this 5Ø.158 acre tract is contiguous and adjacent to the
<br />current boundaries of the City of San Marcos, Texas: now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That that property more particularly described in
<br />Exhibit A which is attached hereto and incorporated herein for all
<br />purposes, being 5Ø .158 acres of land adjoining the existing city
<br />limits of the City of San Marcos, Texas, fronting on the southeast
<br />right-of-way line of Interstate Highway 35 at its intersection with
<br />Center Point Road, Hays County, Texas, be, and the same is hereby,
<br />annexed to the City of San Marcos, Texas.

<br />SECTION 2. That the Service Plan for this area, a copy of which
<br />is attached hereto as Exhibit B and incorporated herein for all
<br />purposes, is hereby approved.
<br />
<br />SECTION 3. That the corporate limits of the City are hereby
<br />extended to include this described territory.
<br />
<br />SECTION 4. That this described territory shall henceforth be a
<br />part of the City of San Marcos, Texas, and any inhabitants thereof
<br />shall be entitled to all the rights and privileges of all citizens,
