<br />(() <br />(;;)--' 9 <br />(:)-- <br />,- <br />tQ.~ <br />- <br /> <br />~ <br />~ <br />ORDINANCE 1990- 69 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING PORTIONS OF THE <br />CITY'S PARKING REGULATIONS; PROVIDING FOR <br />PENALTIES; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; <br />PROVIDING FOR PUBLICA'rION; DECLARING AN <br />EMERGENCY AND PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1: That Sec. 29~1'l1 of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />Sec. 29-171. Pê~king Limited by Specified Time. <br /> <br />When signs or markings are placed giving notice thereof, <br />no person shall stop, stand, or park a vehicle for a period <br />of time longer than the the time indicated on the signs or <br />markings on any day upon any public streets or public areas <br />described on a map adopted with reference to this section by <br />separate ordinance. A separate violation of this section <br />shall be deemed to be committed for each separate period of <br />time, regardless of whether such violations occur on a <br />single day. <br /> <br /> <br />SECTION 2. That Section 29-183(1) of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />(1) Parking overtime <br /> <br />If paid in three (3) days. ....................... $ 5.00 <br /> <br />After three (3) days. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $20.00 <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 4. That all ordinances or parts of ordinances in <br />conflict herewith are hereby repealed. <br /> <br />SECTION 5. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions <br />of the Charter requiring that ordinances shall be presented at <br />three separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date <br />of its final passage be suspended, and these provisions are hereby <br />suspended, and this Ordinance shall take effect and be in full <br />force and effect from and after October 1, 1990, and after its <br />publication in a newspaper of general circulation within the City <br />as provided by the City Charter of the City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this <br /> <br /> <br /> <br /> <br /> <br />ci.~ est: , '" /1)17\1[, ,) APpro, ve,d: <br />. ~ UI{}~ ~'~6. <br />~ nis K.
