~ 10 ~ G"' - ORDINANCE NO. 199Ø - 70 AN ORDINl\NCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS kMENDING THE CITY BUDGET ORDINANCE FOR THE 1989-19911 FISCAL YEAR (ORDINANCE 1989-38) TO PROVIDE FUNDING FOR THE SCADl\ SYSTEM AND VICTORY GARDENS CIP PROJECTS; AND DECLARING AN EHERGENCY. \oJHEREAS, after publ ication of notice on .July 391, 19a9, the City Council of the City of San ~'1arcos, Texas, held a pubLic hearing on August 14, 1989, on the budget proposed by th~~ City Hanager for said City for the fiscal year beginning October 1, 1989; and, ìlHEREAS, at the public hearing all interested persons vJere given an opportunity to be heard for or against any item or the amount of any item therein contained: and, HlfEREi\S, after this public hearing, the City Council adopted the budget for toe City for the fiscal year beginning October 1, 1989 ani! ending on September 30, 199Ø, on September 11, 1989: and, VnIEREAS, this budget set forth itemized estimates of the expense of conducting the San ê1arcos municipal government for that fiscal year and appropriated money for the various funrls and purposes of such estimate: and, tlHEREAS, in accordance with Section 8.16 of the City Charter of the City of San r'1arcos, Texas, the City Counci 1 declares that a publ ic necessity exists \'Thich requires amendment of the budget; now, therefore, BE I'r ORDAINED BY THE CITY COUNCIL OF THE CITY OF SåN ~1ARCOS, TEXAS: SECTION 1. That that the City Budget Ordinance for the 1989-199;'1 Fiscal Year (Ordinance 1989-38) is hereby amended as set forth in the att.ached Exhibit A, B, in order to provide funding for the "latf~r and \'lastewater Supervisory Control and Data Acquisition (SCADA) System and Victory Gardens CIP Projects, respectively. SECTION 2,. That these revisions and reappropriations which shall be the amended budget for the City of San Marcos, Texas, for the fiscal year 1989-1990 beginning October l, 1989 and ending on September 30, 199Ø, are hereby approved and adopted. SECTION 3. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at t.hree separate meetings and that no ordinance shall become effective until the expiration of ten (lØ) days following the date of its final passage be suspended, and thesE~ provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Harcos.
