~8 RESOLUTION 1990- 116 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF CONTRACTS BETWEEN rl'n~ CITY AND NETWORK COMPUTING CORPORATION AND ITRON, INC. FOR THE PROCUREMENT OF AN ELECTRONIC METER READING SYSTEM; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City solicited proposals for the procurement of an electronic meter reading system compatible with the City's water/wastewater and electric utility billing systems; and, WHEREAS, Network Computing Corporation ("NCC") submitted a proposal as a distributor of Itron, Inc., a manufacturer of electronic meter reading equipment, in response to the City's solicitation; and, WHEREAS, the proposal submitted by NCC has been determined to be the most advantageous to the City considering the relative importance of price and other evaluation factors included in the City's solicitation for proposals; and, WHEREAS, the proposal submitted by NCC calls for the execution of a Purchase Agreement between the City and NCC, together with Software License and System Support Services Agreements between the City and Itron, Inc.; now, therefore, BE IT RESOLVED BY THB CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXÞ~S: PART 1. That the terms and conditions of the Purchase Agreement for Itron Data Capture Systems between the City and NCC, and the Software License and System Warranty Agreement for Itron Data Capture Systems and the Terms and Conditions for System Support Services between the City and Itron, Inc., each in the form attached to this Resolution, are hereby approved. PART 2. That the City Manager, Larry D. Gilley, is hereby authorized to execute these contracts on behalf of the city. PART 3.
