<br /> 1. The AlIens shall sign and present to the City the easement <br /> that is attached hereto as Exhibit II BII (the II Easementll ). <br /> 2. The City shall sign and present to the AlIens the quitclaim <br /> deed that is attached hereto as Exhibit IICII (the "Quitclaim <br /> Deed" ). <br /> 3. The instruments described in paragraphs 1 and 2 above shall <br /> be executed at the same time that this Agreement is <br /> executed. The Easement will be held in escrow by the <br /> AlIens' attorney, and the Quitclaim Deed will be held in <br /> escrow by the City's attorney. Prior to the exchange of the <br /> instruments set out in paragraphs 1 and 2 above, the City <br /> shall reconfigure the Electrical Utility Lines so that they <br /> are contained within the boundaries of the Easement and so <br /> that they conform to all of the restrictions of the <br /> Eas ement. After the City has completed the work described <br /> in this Agreement, the AlIens' attorney will deliver the <br /> Easement to the City's attorney, and the City's attorney <br /> will deliver the Quitclaim Deed to the AlIens's attorney. <br /> Each party will be responsible for the cost of recording the <br /> instrument that it receives. <br /> 4. The AlIens and the City acknowledge that there is presently <br /> a tree on the Property between the Electrical Utility Lines. <br /> Although the trunk of this tree is not within the boundaries <br /> of the Easement, this tree would interfere with the use of <br /> the Easement and may interfere with the use of the Easement <br /> in the future.
