<br />LEASE AGREEMENT
<br />
<br />
<br />THIS AGREEMENT, made and entered into this 9th day of
<br />October, 1990, by and between Beverly A. Goff, whose address is P.O.
<br />Box 494, Kerrville, Texas, 78029, hereinafter called LESSOR, and the
<br />City of San Marcos, Texas, a municipal corporation located in Hays
<br />County, Texas and existing by and under the laws of the State of Texas
<br />whose principal address is at 630 East Hopkins, San Marcos, Texas,
<br />78666, acting through authority conferred on its City Manager, Larry D.
<br />Gilley, hereinafter called LESSEE; witnesseth that:
<br />
<br />In consideration of the rents to be paid and the mutual covenants
<br />to be performed, the parties hereto agree as follows:
<br />
<br />1. DESCRIPTION OF LEASED PREMISES
<br />
<br />LESSOR hereby leases to LESSEE and LESSEE leases from LESSOR a building
<br />located at 1300 E. Main Street, Kerrville, Texas, (hereinafter called
<br />the "Leased Premises") and upon the following described real property,
<br />to-wit:
<br />
<br />Block 80, Lots 14 and IS of the Tivy Addition, Kerrville, Kerr
<br />County, Texas.
<br />
<br />2. OUIET POSSESSION
<br />
<br />The LESSOR covenants that it has good title to said real estate, and
<br />that LESSEE, upon paying the rentals herein required and observing,
<br />performing and keeping all and singular the covenants and agreements
<br />herein specified to be kept and performed by LESSEE shall, and may
<br />lawfully, peacefully, quietly and exclusively have, hold, use, occupy,
<br />possess and enjoy the premises hereby leased for and during the term
<br />hereof, without any hindrance, eviction, molestation, or interruption
<br />of or by the LESSOR, or other person or persons.

<br />3. TERM AND "AT WILL" TERMINATION
<br />
<br />The LESSOR agrees, and does hereby, lease the premises to the LESSEE
<br />for an subsequent term of twenty-four (24) months, commencing on the
<br />1st day of October 1990 and continuing through September 30, 1992
<br />unless sooner terminated as provided hereinafter. This agreement may
<br />be terminated by LESSEE, at will, upon 10 days' prior written notice to
<br />LESSOR. This agreement may be terminated by LESSOR, at will, upon 30
<br />days' prior written notice to LESSEE.

<br />4. RENEWAL
<br />
<br />It is further agreed that, at the expiration of the subsequent term,
<br />the LESSEE shall have the right, exercisable at its sole option, to
<br />extend this lease for one additional term of one (I) year upon the
<br />giving by LESSEE of ten (10) days' prior written notice to LESSOR.
<br />
<br />5. RENT
<br />
<br />As rent for the premises, the LESSEE agrees. to pay to the LESSOR
<br />at P.O. Box 494, Kerrville, Texas, or at such other places as are
<br />mutually agreed, the amount of Four Hundred Dollars ($400.00) per
<br />month, payable in advance prior to the first day of each month of the
<br />lease term.

<br />If the commencement date of the term of this lease shall be other
<br />than the first day of the calendar month, the rent for such partial
<br />month shall be calculated and prorated on the basis of a 30-day
<br />calendar month.
<br />
<br />6. USE OF LEASED PREMISES
<br />
<br />LESSEE may use the leased premises for the following purposes:
<br />
<br />Performance of professional, administrative and clerical services
<br />by San Marcos, Texas Women's, Infants' and Children's (WIC) Project
<br />No. 36.
