<br /> -5- <br /> SECTION lO. SCHEDULE OF RATES, MAPS, CONTRACTS, REPORTS. <br /> <br /> 10.1. Grantee shall keep on file with the City a schedule <br /> setting forth its current residential, commercial, and industrial <br /> rates for natural gas and services rendered under substantially <br /> the same conditions to consumers of the same classification. <br /> Nothing contained in this ordinance, however, shall adversely <br /> affect Grantee's right to apply for an increase in any of its <br /> rates at any time during the term hereof and to a lawful and <br /> equitable decision with respect to any such application. <br /> lO.2. Grantee shall keep on file with the City maps showing <br /> the current location of all pipelines, distribution mains, city <br /> gates, regulator stations and other components of Grantee's <br /> natural gas distribution facilities located in the City. These <br /> maps shall be updated at least annually. <br /> 10.3. Grantee shall file annually with the office of City <br /> Secretary, no later than three (3) months after the end of <br /> Grantee's fiscal year, a copy of its annual report to its <br /> stockholders and a financial report applicable to Grantee's system <br /> serving the City. This financial report shall include an income <br /> statement applicable to Grantee's operations during the preceding <br /> twelve (l2) month period, a balance sheet and a statement of the <br /> properties devoted to Grantee's system operations, and shall <br /> include information pertaining to the transport of gas through the <br /> City in accordance with Section 6.1. This financial report shall <br /> be certified as correct by an authorized officer of Grantee and <br /> there shall be submitted along with it such other reasonable <br /> information as City Council shall request. Upon request, Grantee <br /> shall provide copies of its annual audit performed by an <br /> independent certified public accountant, if such an audit has been <br /> performed. <br /> SECTION 11. OUALITY OF SERVICE. <br /> <br /> 11.1. Grantee agrees to comply with all applicable customer <br /> service regulations of the Railroad Commission of Texas or any <br /> similar state regulatory authority. <br /> 11. 2. Grantee shall keep on file with the City a copy of its <br /> current customer service policies. <br /> 11. 3. The City shall have the authority to investigate <br /> customer service complaints within the City. The City Manager of <br /> the City may direct written inquiries to the Grantee regarding any <br /> complaint, and Grantee shall provide a written response to the <br /> inquiry. <br /> l1.4. Topics of customer service complaints subject to <br /> investigation include, but are not limited to, service rate <br /> structures; franchise fee; free or discounted services; <br /> application of new technologies; services provided; privacy; <br /> amendments to this ordinance; judicial, FERC, and Railroad <br /> Commission rulings; line extension policies1 and Grantee or City <br /> rules. <br /> SECTION 12. RATE CLASSIFICATIONS. <br /> Grantee shall not, as to rates or services, make or grant any <br /> unreasonable preference or advantage to any corporation or person <br /> within any classification, or subject any corporation or person <br /> within any classification to any unreasonable prejudice or <br /> disadvantage. Grantee shall not establish or maintain any <br /> unreasonable differences as to rates of service between classes of <br /> service. <br /> SECTION 13. COMPLIANCE WITH CHARTER AND ORDINANCES. <br /> This franchise, the rights granted hereby and the operations <br /> and activities performed by Grantee pursuant hereto shall be <br /> subject to applicable provisions of the Charter of the City of San <br /> Marcos.
