<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY ZONING 7.881 ACRES,
<br />LOCATED AT 1612 AQUARENA SPRINGS FROM "c"
<br />Cmn.ŒRCIAL DISTRICT AND "M" SINGLE-FAMILY,
<br />DUPLEX, AND NEIGHBORHOOD BUSINESS DISTRICT TO
<br />"MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY)
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on October 2,1990, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "c" Commercial District and "M" Single-family,
<br />Duplex, and Neighborhood Business District to "MF-4" Multi-family
<br />District (High Density) of 7.881 acres located at 1612 Aquarena
<br />Springs.
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning Commission did, on October 2,1990, consider the request and
<br />voted to approve it and has recommended that the request be
<br />approved by the City Council of the City; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the 10th
<br />day of December, 1990, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~UURCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the City, as
<br />described in section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "C"
<br />Commercial District and "M" Single-family, Duplex, and Neighborhood
<br />Business District to "MF-4" Multi-family District (High Density):

<br />TRACT ONE. 4.118 acres of land, being a portion of the
<br />J.M. Veramendi League No. Two in Hays County, Texas, and
<br />being a portion of three tracts of land as conveyed to
<br />Gus Mecey, et al, by H.Y. Price Enterprises, et al, by
<br />deeds as recorded in Volume 220, Page 206, Volume 220,
<br />Page 36l, and Volume 229, page 622, of the Deed Records
<br />of Hays County, Texas, said 4. ll8 acres being more
<br />particularly described by met.¡;s and bounds as follows,
<br />to-wit:
<br />
<br />BEGINNING at an iron stake in the northeast line of
<br />Jackson Avenue, a 30.00 foot gravel road, said iron stake
<br />being the southwest corner of that 9.41 acre tract of
<br />land described in a deed from H.Y. Price Enterprises to
<br />Gus Mecey, et al, as recorded in Volume 220, page 206, of
<br />the Deed Records of Hays County, Texas, for the southwest
<br />corner of the herein described tract of land;
<br />
<br />THENCE with the Northeast line of Jackson Avenue and the
<br />southwest line of the said 9.4l acre tract North 44 042'
<br />West 375.39 feet to a point for angle point;
<br />
<br />THENCE North 42047' West 75.00 feet to a point, said
<br />point being the northwest corner of the herein described
