<br />~UG 22 '90 1 1 , 39 L~D P.06 <br /> VOl. 77 PACE 632 856 . 13} <br /> Marcos Airport and a northwest line of the Gary Job Corps <br /> Center, a distance of 45.79 feet to a point (point 828) <br /> on -the said twenty-fourth call in those said field notes <br /> recorded in said Volume 313, from which a 1/2 inch <br /> diameter iron bar (point 813) found at the end point of <br /> the said third call and 2 inches south of a pine corner <br /> post bears North 53 degrees 05 minutes 48 seconds East <br /> a distance of 0.11 foot; <br /> Thence, Sou th 89 degrees 52 minutes 04 seconds East a <br /> distance of 43l.48 feet along the said twenty-fourth <br /> call, which is a south line of the San Marcos Airport and <br /> a north line of the Gary Job Corps Center, to the point <br /> of beginning. <br /> The tract of land hereby conveyed contains 42.47 acres, more <br />or less. <br />This Grant is subject to the followinq covenants and conditions <br />which the Grantee, by acceptance of this deed, assumes for itself <br />and its successors and assigns, as covenants running with the land: <br /> 1. THAT, the Grantee will use the property interest for <br />airport purposes, and will develop that interest for airport <br />purposes within two years from after the date of this conveyance, <br />except that if the property interest is necessary to meet future <br />development of an airport, in accordance with the National Airport <br />System Plan, the Grantee will develop that interest for airport <br />purposes on or before the period provided in the plan or within a <br />period satisfactory to the Administrator and any interim use of <br />that interest will be subject to such terms and conditions as the <br />Administrator may prescribe. <br /> 2. THAT, the airport, and its appurtenant areas and its <br />buildings and facilities, whether or not the land conveyed, will <br />be operated as a public airport on fair and reasonable te rms , <br />without discrimination on the basis of age, religion, sex, <br />handicap, race, color or national origin, as to airport employment, <br />practices, and as to accommodations, services, facilities, and <br />other public uses of the airport. <br /> 3. THAT, the Grantee will not grant or permit any exclusive <br />right forbidden by Section 308{a) of the Federal Aviation Act of <br />1958 (49 U.S.C. 134ga) at the Airport, or at any other airport now <br />owned or controlled by it. <br /> 4. THAT, in the operation of the airport and its appurtenant <br />areas, the Grantee: <br /> a. agrees that no person shall be excluded from <br /> participation, be denied any benefi ts or be otherwise <br /> subjected to any discrimination, on the qrounds of race, <br /> color or national origin; <br />
