<br /> 28 <br /> RESOLUTION 199Ø - ] ?16 R <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE CITY'S ONE-YEAR <br /> PARTICIPATION IN PURCHASING PROGRAMS OF THE STATE <br /> PURCHAS ING AND GENERAL SERVICES COMMISSION FOR THE <br /> ACQUISITION OF CERTAIN PRODUCTS FROM THE <br /> COMMISSION'S ANNUAL CONTRACTS FOR SUCH ITEMS; <br /> AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN <br /> AND DELIVER ALL NECESSARY REQUESTS AND OTHER <br /> DOCUMENTS IN CONNECTION THEREWITH, PROVIDING THAT <br /> THE CITY WILL BE RESPONSIBLE FOR PAYMENT DIRECTLY <br /> TO THE VENDOR UNDER EACH SUCH CONTRACT AND WILL BE <br /> RESPONSIBLE FOR THE VENDOR'S COMPLIANCE WITH ALL <br /> CONDITIONS OF DELIVERY AND QUALITY OF PURCHASED <br /> ITEMS, AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos, Texas pursuant to the authority <br />granted by Subchapter D, Sections (271.Ø81-271.Ø83), Vernon's <br />Annotated Texas Local Government Code, as amended, desires to <br />participate in certain below-described purchasing programs of the <br />State Purchasing and General Services Commission; and <br /> WHEREAS, the City Council of the City is of the opinion that <br />participation in these programs will be highly beneficial to the <br />taxpayers of this City through the anticipated savings to be <br />realized; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART I. That the City of San Marcos, Texas, does hereby request <br />the State Purchasing and General Services Commission to include the <br />City's stated need for the following contract class numbers as <br />follows: <br /> Ø7Ø - Automobiles and Light Duty trucks <br /> PART 2. That the City's participation in such purchasing <br />programs of the State Purchasing and General Services Commission for <br />the acquisition of such items is hereby authorized. <br /> PART 3. That the City Manager is hereby authorized and directed <br />to sign and deliver all necessary requests and other documents in <br />connection therewith for and on behalf of the City. <br /> PART 4. That the City of San Marcos, Texas, will pu:J?chase the <br />items from the contracts made pursuant to this Resolution and <br />(Subchapter D, Sections 271.Ø81-271.Ø83), Vernon's Annotated Texas <br />Local Government Code, except in emergencies, and will be responsible <br />for payment directly to the vendor under each such contract and will <br />be responsible for the vendor's compliance with all conditions of <br />delivery and quality of purchased items. <br /> PART 5.
