34 AMENDMENT NO.2 TO THE CONTRACT FOR JANITORIAL MAINTENANCE FOR THE CITY OF SAN MARCOS, TEXAS WHEREAS, by execution of an owner-contractor agreement on February 28, 1986, the City of San Marcos, Texas did enter into a contract with Gene Bagwell for janitorial maintenance for said City; and, WHEREAS, said owner-contractor agreement provided a three year primary term with contractor's option to renew for an additional two year period; and, WHEREAS, said contractor has properly elected to renew said contract for an additional two year period; and, WHEREAS, the City and said Contractor have agreed on new consideration for the renewal period; now, therefore, It is understood and agreed by the parties hereto that the following amendments incorporated into the contract documents of the aforesaid contract are subject to the terms and provisions of the contract, except as stated below. 1. Paragraph 3 of the Notice of Award and Paragraph VII of the Owner-Contractor agreement, as amended, are hereby revised to change the term of the agreement to two (2) years, commencing on February 1, 1989 and continuing until January 31, 1991, unless earlier terminated as provided in Paragraph VI of the Owner-Contractor agreement. 2. The contractor I s Bid and paragraph 2 of the Notice of Award are hereby revised to change the consideration to be paid by Owner to Contractor for completion of the project in accordance with the contract documents to: $ 4,496.31 per month $ 53,955.72 per year $107,911.44 for 2 years 3. Any and all provisions in conflict with the terms of this amendment shall not be applicable or effective.
