<br />XII. <br /> <br />Ci ty shall be responsible for supplying water, wastewater, <br /> <br />natural <br /> <br />gas, <br /> <br />and electricity, <br /> <br />and garbage collection <br /> <br />services <br /> <br />necessarily used by Flight Operations in connection with its use <br /> <br />of the demised premises. <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Paragraph XXII of said lease, is hereby rescinded and the <br />following substituted in its place: <br /> <br />XXII. <br /> <br />Flight Operations <br /> <br />shall be responsible for all <br /> <br />janitorial <br /> <br />maintenance and upkeep of the terminal building area which is <br /> <br />leased <br /> <br />hereunder <br /> <br />to <br /> <br />Flight <br /> <br />Operations <br /> <br />exclusively, <br /> <br />and Flight <br /> <br />Operations agrees to keep said area in a sightly condition. <br /> <br />City <br /> <br />shall be responsible for all maintenance and upkeep, janitorial or <br /> <br />otherwise, of the interior common areas and exterior grounds of <br /> <br />the terminal building, and City agrees to keep said areas in a <br /> <br />sightly condition. <br /> <br />In addition, City shall be responsible for all <br /> <br />necessary building repairs in the terminal building. <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Paragraph XXV. of said lease, as amended, is hereby rescinded <br />and the following substituted in its place: <br /> <br />XXV. <br /> <br />By execution of this amendment, both parties agree that in <br /> <br />addition to the provisions herein, all provisions of the original <br /> <br />lease executed September 9, 1980, as previously amended, which are <br /> <br />not amended or substituted by this Amendment Number 3 shall apply <br /> <br />to <br /> <br />the temporary <br /> <br />facilities <br /> <br />described in Paragraph lA, <br /> <br />above, <br /> <br />shall continue to be in force and effect after Flight Operations <br /> <br />takes possession of the demised premises as shown on Exhibit 3. <br /> <br />In Witness Whereof, we, the contracting parties, by our duly <br /> <br />authorized agents, hereto affix our signatures and seals. <br /> <br />CITY OF SAN MARCOS, TEXAS, <br /> <br /> <br />~~~ <br /> <br />LESSOR <br /> <br />Attest: <br />( .
