118 RESOLUTION 1989-30R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE CITY MANAGER TO ISSUE CERTIFICATES OF CREDIT FOR THE PAYMENT OF UTILITY TAP FEES IN CONSIDERATION FOR THE CONVEYANCE OF RIGHT-OF-WAY, DRAINAGE AND/OR PUBLIC UTILITY EASEMENTS, DIRECTING THE CITY SECRETARY TO ATTEST TO AND SEAL SAID CERTIFICATES AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos desires to implement its capital improvements program in an efficient and expeditious manner; and, WHEREAS, it is sometimes necessary for said City to obtain right-of-way, drainage and/or public utility easements from landowners for the construction of capital improvements; and, WHEREAS, landowners must pay water tap and sewer tap fees for connection to said City's water and sewer systems; and, WHEREAS, the fair market value of some of the said right-of-way, drainage and/or public utility easements is equal to or in excess of said water tap and/or sewer tap fees; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the City Manager of the City of Marcos is hereby authorized to issue site-specific certificates of credit not to exceed Two Hundred Fifty Dollars ($2SØ.ØØ) in the form attached hereto as Exhibit "A," for the payment of water and sewer tap fees to landowners in consideration for said landowners' conveyance to the City of right-of-way, drainage, and/or public utility easements necessary for the construction of a capital improvements project where the fair market value of said easement(s) is equal to or in excess of the credit issued. PART 2. That this Resolution shall be in full force and effect immediately from and after its passage.
