<br />2 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting January 9, 1984 Page 2 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY ZONING 19.9 ACRES, MORE OR LESS, <br />OF LAND IN THE J. M. VERAMENDI LEAGUE NO. ONE, HAYS <br />COUNTY, TEXAS, AND BEING A PART OF 219.07 ACRES <br />DESCRIBED IN A DEED FROM W. C. CARSON TO SAN MARCOS <br />EUSINESS PARK BY DEED DATED JUNE 3, 1983 AND RECORDED <br />IN VOLUME 394, PAGE 895, HAYS COUNTY DEED RECORDS, <br />A/K/A 2005 HUNTER ROAD, FROM "AO" (AGRICULTURAL-OPEN <br />SPACE DISTRICT) TO "c" (COMMERCIAL DISTRICT). <br /> <br />Mayor Craddock asked if anyone wished to speak in favor of the Ordinance. <br />Jim Byrn was present representing the owner of the property, J. Tapp. <br />He reviewed with the Council the present flow of traffic of the City <br />to shopping centers in the City and the proposed flow of traffic In <br />the event this property is zoned commercial and the proposed shopping <br />center is constructed as planned and expressed it would have a favor- <br />able impact on the traffic patterns of the city. Mr. Farr asked if <br />Mr. Byrn could estimate a projection of LUE usage for such a project, <br />and Mr. Byrn indicated a maximum LUE usage could be estimated and he <br />was asked to provide this information to the Council prior to third <br />reading of the Ordinance. Mr. Byrn stated sewage lines and a 12" <br />water line were available in the general vicinity of the area. Mr. <br />Byrn stated there are approximately 27 acres of land to be developed, <br />21 acres as a shopping center and 6 acres which are in the floodway. <br />Mr. Byrn stated the owner was in agreement to give 20 feet along <br />Hunter Road, which could be done in the platting process, or before <br />third reading if the Council desired. No one else wished to speak <br />in favor or in opposition to the zoning change, so Mayor Craddock <br />closed the public hearing. Ms. Kissler moved to approve the Ordinance <br />on first reading and Mr. Guerra seconded the motion, which passed unani- <br />mously. <br /> <br />Mayor Craddock opened a public hearing to consider approval of an Ordin- <br />ance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 13.425 <br />ACRES, MORE OR LESS, OF LAND AREA BEING TWO TRACTS <br />OF LAND IN THE J. M. VERAMENDI LEAGUE NO.2 IN SAN <br />MARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT <br />18.2 ACRE TRACT NO.3 DESCRIBED IN A DEED FROM F. C. <br />DAVIS, ET UX, TO CHARLES A. ZUNKER DATED MAY 31, 1946 <br />AND RECORDED IN VOLUME 135, PAGE 34 OF THE HAYS COUNTY <br />DEED RECORDS, A/K/A 1111 THORPE LANE, FROM "M" (SINGLE, <br />DUPLEX, MULTIPLE FAMILY DWELLINGS AND NEIGHBORHOOD <br />BUSINESS) TO "c" (COMMERCIAL DISTRICT). <br /> <br />Mayor Craddock asked if anyone wished to speak in favor of the zonlng <br />change. David Morrison was present representing the owner of the pro- <br />perty, Jon Wilson, and introduced Herbert Golden of NPC to the Council. <br />Mr. Golden said the property was across from Springtown Mall and would <br />be used for retail sales. He said the traffic of the development would <br />funnel onto Stadium Drive. It was brought out Stadium Drive lS still <br />owned by the University and the Council expressed interest in Stadium <br />Drive being dedicated public right-of-way prior to third reading of this <br />Ordinance. Mayor Craddock also expressed an interest in a third lane <br />on Thorpe, turning right onto Hopkins (Ranch Road 12). Joe Garza stated <br />Thorpe Lane currently conforms to our Master Plan.
