<br /> Such insurance as is required under this <br /> paragraph 7 shall be written so that City will <br /> be notified in writing, by registered mail, in <br /> the event of cancellation, restrictive <br /> amendment or non-renewal at least thirty (30) <br /> days prior to such action. A Certificate of <br /> Insurance shall be filed with City prior to <br /> the commencement of operation under this <br /> agreement and is subject to City's approval. <br /> All insurance required under this paragraph 7 <br /> shall be written with the City of San Marcos, <br /> Texas, as an additional insured. <br /> Any insurance policy herein required or <br /> procured by MCKEE shall contain an express <br /> waiver of any rights of subrogration by the <br /> insurance company against City. <br /> The stated limits of insurance required by <br /> this paragraph 7 are MINIMUM ONLY and it shall <br /> be MCKEE's responsibility to determine what <br /> limits are adequate. These minimum limits may <br /> be basic policy limits or any combination of <br /> basic limits and umbrella limits. In any <br /> event, MCKEE is fully responsible for all <br /> losses arising out of, resulting from or <br /> connected with operations under this agreement <br /> whether or not said losses are coverable by <br /> insurance. City's acceptance of a Certificate <br /> of Insurance that in any respect does not <br /> comply with the requirements of this agreement <br /> does not release MCKEE from compliance <br /> herewith. <br /> 8. Indemnity. <br /> IICKEE shall to the fullest extent pe:r:mitted by law, <br /> indemnify and hold Owner harmless fro. and against <br /> a1l clai8s, damages, losses and expenses, including <br /> -4- <br />
