<br />person or any of his/her immediate family, having duty to <br />recommend, the right to vote upon, or any other direct <br />influence on the selection of consultants to provide services <br />to the CITY within the two (2) years preceding the execution <br />of the Agreement. A campaign contribution, as defined by the <br />Texas Election Code of the City of San Marcos Code of <br />Ordinances shall not be considered as a valuable gift for the <br />purposes of this Agreement. <br />ARTICLE XV - INTEREST OF MEMBERS OF OR DELEGATES TO CONGRESS <br />No member of, or delegate to, the Congress of the United <br />States shall be admitted to any share or part of this <br />Contract or to any benefit arising therefrom. <br /> ARTICLE XVI - ACKNOWLEDGEMENT OF FINANCIAL SUPPORT <br />CONSULTANT shall acknowledge financial support whenever work <br />funded, in whole or in part, by this Contract is publicized <br />or reported in any news media or publication. All reports, <br />maps, and other documents completed with UMTA funding as part <br />of this Contract shall carry the following notation on the <br />front cover or a title page on on the face of maps: <br /> Preparation of this report has been financed in part by <br /> a grant from the Urban Mass Transportation <br /> Administration of the United States Department of <br /> Transportation under the Urban Mass Transportation Act <br /> of 1964, as Amended. <br />It is understood that funding for this Agreement is being <br />contributed by the CITY, HAYS COUNTY, AND SOUTHWEST TEXAS <br />STATE UNIVERSITY. CONSULTANT and CITY agree that if, for any <br />reason, funding ceases for this Agreement, from any source, <br />then this Agreement shall terminate and/or shall be subject <br />to re-negotiation. <br /> ARTICLE XVII - COVENANT AGAINST CONTINGENT FEES <br />CONSULTANT warrants that it has not employed or retained any <br />company or person, other than a bona fide employee working <br />solely for CONSULTANT, to solicit or secure this Contract and <br />that it has not paid or agreed to pay any company or person, <br />other than a bona fide employee working solely for <br />CONSULTANT, any fee, commission, percentage, brokerage fee., <br />gift, or other consideration contingent upon or resulting <br />from the award or making of this Contract. For breach of <br />violation of this warranty, the CITY shall have the right to <br />annul this Contract without liability, or at its discretion <br />to ded uct from this Contract the price of consideration or <br />otherwise recover the full amount of sUch fee, commission, <br />percentage, brokerage fee, gift, or contingent fee. <br /> -7- <br />
