Exhibit "A" 37 AMENDMENT NO. 1 TO THE CONTRACT FOR CONSULTING SERVICES WITH HAYNES-EAGLIN-WATERS IN CONNECTION WITH THE DUNBAR/VICTORY GARDENS COMMUNITY DEVELOPMENT PROJECT WHEREAS, by execution on March, 1989, the City of San Marcos, Texas, did enter into a contract for professional services with Haynes-Eaglin-Waters ("HEW") for management consulting services: now, therefore, It is understood and agreed by the parties hereto that the following amendments are incorporated into Paragraph I, Scope of Services, and Paragraph IV, Compensation, of the aforesaid contract and are subject to the terms and provisions of the contract, except as stated below. Paragraph I, Scope of Services is amended by the addition of a new subsection, II I, " to read as follows: 1. Land acquisition--HEW shall provide land acquisition negotiation services in accordance with City direction and federal regulations and TDoC procedures for the City's acquisition of all necessary easements for the construction of the wastewater, street and drainage improvements. Paragraph IV, Compensation, is amended to read as follows: For the services described in Paragraph I, (A)(B)(C)(D)(E)(F) (G) & (H), City shall compensate HEW, a fee not to exceed Fifteen Thousand Dollars ($15, øøø. ØØ). For the serv ices described in Paragraph I(I}, City shall compensate HEW an hourly fee of Sixty Dollars ($6Ø.ØØ) not to exceed a total of Nine Thousand Five Hundred Dollars ($9,SØØ.ØØ).
