<br /> This Agreement may be amended only by written instrument signed by both <br /> Owner and Engineer. <br /> ARTICLE 12 <br /> œrmm DUTIES AS SET FORTH IN CORSftUCTIOR CONTRACT DOCUIIElftS <br /> 12.1 Engineer shall have such other duties and responsibilities <br /> and limitations of authority as agreed to by Engineer in writing and as <br /> are set forth in the construction documents which are made a part <br /> hereof and incorporated herein by reference as if copied herein <br /> verbatim. However, in the event of conflict, dispute, or discrepancy <br /> between the provisions of this Agreement and the construction <br /> documents, the more restrictive and/or burdensome provisions shall <br /> govern and control. <br /> ARTICLE 13 <br /> BASIS OF COBPEHSATIOR <br /> The Owner shall compensate the Engineer for the Scope of Services <br /> provided, in accordance with Article 5, Payments to the Engineer, and <br /> the other terms and conditions of this Agreement, as follows: <br /> 13.1 BASIC COIIPERSATIOR <br /> 13.1.1 Basic Compensation shall be completed and paid as follows: <br /> Upon completion of schematic and <br /> design development phases as <br /> described in Article 1.1 & 1.2 $4,000.00 <br /> Upon completion of surveying An hourly wage in <br /> phase as described in Article 1.3 accordance with the <br /> schedule of costs in <br /> Article l3.2.1, but <br /> not to exceed $5,800.00 <br /> Upon completion of the construction <br /> documents phase as described in <br /> Article 1. 4 $ 4,000.00 <br /> TOTAL COMPENSATION FOR BASIC COMPENSATION: <br /> NOT TO EXCEED $13,800.00 <br /> Upon completion of services in In accordance with <br /> the construction phase as Article 13.2.1 <br /> described in Article 1.5 <br /> 13.2 COIIPERSATIOR FOR ADDITIORAL SERVICES <br /> l3.2.1 For Additional Services of the Engineer, as described in <br /> Paragraph 1.5 and 1.6, compensation shall be computed as follows: <br /> PRINCIPALS <br /> James E.
