<br />A RE~OLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP)
<br />OF THE MASTER PLAN OF SAID CITY, OF ALL OF THAT
<br />CERTAIN TRACT OF PARCEL OF LAND LOCATED IN HAYS COUNTY,
<br />TEXAS, AND BEING A PART OF THE J.M. VERAMENDI SURVEY NO.
<br />ONE (1) TO THE CITY OF SAN MARCOS, AS CONVEYED BY THAT
<br />DEED FROM HENRY NETHERLAND, ET OX., TO BOB P. REED AND
<br />MERLE M. REED, DATED JUNE 22,1951, OF RECORD IN VOLUME
<br />150, PAGE 286, DEED RECORDS OF HAYS COUNTY, TEXAS,
<br />LOCATED AT 1808 HUNTER ROAD FROM PERMANENT OPEN SPACE/
<br />FLOOD PLAIN TO COMMERCIAL AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />WHEREAS, on February 21,1989, during the Joint Planning
<br />and Zoning Commission meeting of the City of San Marcos a public
<br />hearing was held regarding a request to amend the Future Land
<br />Use Plan (Map) of the Master Plan from Permanent Open Space/Flood
<br />Plain to Commercial of all of that certain tract or parcel of
<br />land located in Hays County, Texas, and being a part of the J.M.
<br />Veramendi Survey No. One (1) to the City of San Marcos, located
<br />at 1808 Hunter Road, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commissions did, on February 21, 1989, consider said request and
<br />voted to approve the same and have recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 10 day
<br />of July, 1989, regarding such request; and,
<br />
<br />WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />PART 1. That the following described real property located in
<br />San Marcos, Hays County, Texas, which is in an area shown on the
<br />Future Land Use Plan (Map) of the Master Plan of the City of San Marcos
<br />as Permanent Open Space/Flood Plain shall be shown as Commercial on
<br />said map.
<br />
<br />All of that certain tract or parcel of land located in Hays
<br />County, Texas, and being a part of the J.M. Veralnendi Survey No.
<br />One (1) and being more particularly described as follows,
<br />to-wit:

<br />BEGINNING at an iron pipe in the Northwest line of the old Post
<br />Road which bears South 45 degrees East 411.4 varas from a point
<br />in the Northwest line of the J.M. Veramendi League, which bears
<br />South 45 degrees West 170.2 varas from the North corner of the
<br />original 39.1 acre tract from which a 24" L.O. marked with an
<br />old X bears North 82 degrees West 32.0 varas;
<br />
<br />THENCE South 34 degrees 07' West 75.13 varas with the Northwest
<br />line of the old Post Road to an iron pipe for corner;
<br />
<br />THENCE North 45 degrees West 75.13 varas to an iron pipe for
<br />corner;
<br />
<br />THENCE North 34 degrees 07' East 75.13 varas to an iron pipe for
<br />corner;
<br />
<br />THENCE South 45 degrees East 75.13 varas to the PLACE OF
<br />BEGINNING, containing 1.00 acres of land, more or less, and
<br />being a portion of that identical property heretofore described
<br />in and conveyed by a deed, dated August 23, 1946, from R.E.
<br />McKie to Henry Netherland, of record in Volume 135, page 617,
<br />Hays County Deed Records.
<br />
<br />The land hereby conveyed is the identical land described in and
<br />conveyed by that deed from Henry Netherland, et ux., to Bob P.
<br />Reed and Merele M. Reed, dated June 22, 1951, of record in
<br />Volume 150, page 286, Deed Records of Hays County, Texas.
