<br />The Lions Club and/or its Contractor shall purchase and maintain <br /> <br /> <br />(a.) such insurance as will protect them from claims for <br />damages because of bodily injury, personal injury, <br />sickness, disease or death with minimum limits of <br />liability of not less than $500,000.00 each occurrence <br />and $500,000.00 aggregate; <br /> <br />(b.) such insurance as will protect them from claims for <br />damages for injury to or destruction of tangible <br />property of others, including loss of use thereof. Such <br />coverage shall include Broad Form Property Damage and <br />removal of XCU exclusions where applicable. The minimum <br />limits of liability shall be $500,000.00 per occurrence <br />and $500,000.00 aggregate; <br /> <br />(c.) such insurance as will protect them from claims for <br />damages arising out of the maintenance, operation, or <br />use of any owned, non-owned or hired vehicles. Minimum <br />limits of liability for bodily injury and property <br />damage combined shall be not less than $500,000.00 each <br />occurrence; <br /> <br />(d.) Umbrella Form Excess Liability with minimum limits of <br />$1,000,000.00. Umbrella or Extended Coverage must <br />follow form with the primary coverage; <br /> <br />(e.) Property insurance upon the entire Work, including <br />materials not in place at the site to the full insurable <br />value thereof. All such property insurance shall be in <br />an "all risk" form and shall include the interests of <br />the City, the Lions Club an~/or its Contractor, and <br />subcontractors in the work and shall include, but not be <br />limited to, the perils of fire, lightning, flood, <br />collapse, windstorm, hail, explosion, riot, civil <br />commotion, smoke, aircraft, land vehicles, vandalism and <br />malicious mischief. The property insurance shall be <br />endorsed to permit utilization and/or occupancy (as <br />applicable) prior to completion of construction and <br />prior to acceptance by the City. <br /> <br />The insurance required by the above paragraph shall be <br />amended to afford coverage for: <br /> <br />Comprehensive General Liability, Products Liability and/or <br />Completed Operations, and Blanket Broad Form Contractual <br />Liability specifically covering the indemnification assumed <br />by the Lions Club under this Agreement. <br /> <br />All insurance required herein shall be primary over any other <br />insurance coverage the City may have and shall be written so that <br />the City will be notified in writing in the event of cancellation, <br />restrictive amendment or non-renewal at least thirty (30) days <br />prior to such action. Certificates of Insurance shall be filed <br />with the City prior to the commencement of the Work and are <br />subject to the City's approval. Insurance carriers insuring the <br />Lions Club and/or its Contractor in accordance with this <br />Agreement which are not rated by the most recent edition of Best's <br />Key Rating Guide. Property-Casualty, published by A.M. Best <br />Company and insurance carriers having a rating lower than B+VII as <br />shown in the most recent edition of said book, will not be <br />approved by City unless a guaranty bond acceptable to City from a <br />carrier rated B+VII or higher guaranteeing payment of any and all <br />claims of the Lions Club and/or its Contractor is furnished to the <br />City. <br /> <br />All insurance required herein shall be written with the City of <br />San Marcos, Texas as an additional insured. <br /> <br /> <br /> <br /> <br /> <br />-5- t, <br />Q\g( <br />
