96 TEXAS PARKS AND WILDLIFE DEPARTMENT 359 - 0371 TEXAS LOCAL PARKS, RECREATION AND OPEN SPACE FUND AGREEMENT Texas Parks and Wildlife Department Number: 20-00308 Project Name: San Marcos Park Project Period: Date of Project Approval to 3-1-92 Project Cost: $862,932 Approved State Funds: $431,466 PROJECT DESCRIPTION (SCOPE) The City of San Marcos will acquire by purchase/donation 8.84 acres and develop San Marcos Park to include 8 picnic tables with grills, 0.2 mile aggregate river trail, 0.3 mile aggregate hike/bike trail, 0.3 mile nature trail, 12 benches, pedestrian bridge, fencing, trash receptacles, and signs. San Marcos Park ; s located in the centra i area of the Ci ty along the San Marcos River on Riverside Drive at Houston Road west off IH 35. Pre-agreement costs incurred from 7 -1-88 to the date of project approval in the amount not to exceed $1,200 are allowable. For and in consideration of the mutual covenants and benefits hereof, the Texas Parks and ~ildlife Department ("Department"> and the "Sponsor" hereby contract with respect to the above described project as follows: 1. The Sponsor is obligated to adhere to all requirements established for the Texas Local Parks, Recreation and Open Space Fund Program including program guidelines set out at 31 TAC Sec. 61.131 2. No work on the project by the Sponsor shall commence until written notice to proceed has been received from the Department. 3, The Sponsor shall furnish the Department an annual report for a period of five years followi ng the project completion providing to the satisfaction of the Departr:lent information regarding present and anticipated use and development of the project site. 4. The Sponsor shall install and maintain at the project site a permanent sign as prescribed by the Department. 5. All utilities at the project site shall be underground and approved by the Departmen~. 6. The General Provisions dated May 1985 attached hereto are hereby made a part hereof for all purposes. 7. The Agreement is effective upon execution by the Department.
