<br />106 <br />ORDINANCE 1989-34 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF <br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 <br />(VOL. 66) BY ZONING LOTS 72 AND 75, OUT OF THE THIRD <br />DIVISION PARK ADDITION TO THE CITY OF SAN MARCOS, <br />AS RECORDED IN VOLUME 56, PAGE 47 OF THE HAYS COUNTY DEED <br />RECORDS, LOCATED AT 1106 AND 1108 CHESTNUT STREET FROM <br />"R-l" (SINGLE FAMILY DWELLING DISTRICT- LOW DENSITY) TO <br />"MF-2" (MULTI-FAMILY DISTRICT-MEDIUM DENSITY) AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />WHEREAS, on April 18, 1989, the Joint Planning and Zoning <br />Commissions of the City of San Marcos held a public hearing <br />regarding a request to change the zoning from "R-III (Single-Family <br />Dwelling District-Low Densi ty) to "MF-411 (Mul ti-Family District-High <br />Density) of Lots 72 and 75, out of the Third Division Park <br />Addition located at 1106 and 1108 Chestnut Street, to the City of San <br />Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Zoning Commission did, on April 18, 1989, consider said request and <br />voted to deny the same but recommended that a zoning change to MF-2 <br />(Multi-Family District-Medium Density) be approved by the City Council <br />of said City; and, <br /> <br />WHEREAS, said City Council held a public hearing on the 14 day <br />of August, 1989, regarding such request; and, <br /> <br />~VHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the following described real property located in <br />San Marcos, Hays County, Texas, which are presently zoned IIR-llI <br />(Single Family Dwelling District-Low Density) be rezoned to "MF-2" <br />(Multi-Family District-Medium Density): <br /> <br />LOTS 72 AND 75, OUT OF THE THIRD DIVISION PARK ADDITION TO <br />THE CITY OF SAN MARCOS, AS RECORDED IN VOLUME 56, PAGE 47 OF <br />THE HAYS COUNTY DEED RECORDS. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />its passage, and providing that the Council did not vote to reconsider <br />it. If reconsidered on August 28, 1989, it shall be in effect ten <br />days from and after its passage on that date if approved. It shall not <br />go into effect if denied.
