<br /> -16- <br />the LESSEE shall use the premises in compliance with all other <br />requirements imposed by or pursuant to 49 CFR Part 21, <br />Nondiscrimination in Federally Assisted Programs of the Department <br />of Transportation, and as said Regulations may be amended. <br /> xv. <br />LESSOR represents and warrants that LESSOR has full right and <br />lawful authority to enter into and perform LESSOR'S obligations <br />under th i s Ag reemen t for the full term of this Agreement and has <br />title to said demised premises as shown by the indenture between the <br />United States of America and LESSOR. <br /> XVI. <br /> LESSOR further covenants that if LESSEE shall discharge the <br />obligations herein set forth to be performed by LESSEE and shall comply <br />with all applicable local, state and federal laws, rules and <br />regulations, LESSEE shall have and enjoy during the term hereof, <br />quiet and undisturbed possession of said demised premises and all <br />appurtenances appertaining thereto, together with the right to use <br />the runways and taxiways of said Airport as contemplated herein; <br />provided, however, that this Agreement is subject to the prior <br />approval of the Federal Aviation Administration, and the United States <br />of America to take a portion of said Airport for air traffic control <br />activities, weather reporting activities and/or communication <br />activities related to air traffic control, all as provided in said <br />indenture, and in such event, the provisions of this Agreement, insofar <br />as they are inconsistent with such rights of the United States of <br />America and the Federal Aviation Administration shall be suspended. <br />Further, this Agreement shall be subordinate to the provisions of <br />any existing or future agreement between LESSOR and the United States <br />of America relative to the operation or maintenance of Airport, the <br />execution of which has been or may be required as a condition precedent <br />to the expenditure of federal funds for the development of the <br />Airport; provided that if such agreement restricts the operation of <br />the demised premises, equitable rental reductions shall be negotiated. <br />In the event that such rental reductions cannot be negotiated, then <br />this Agreement shall terminate and end sixty (60) days thereafter, and <br />the parties shall have no further obligations hereunder. <br />
