109 THE STATE OF TEXAS CONSOLIDATION AND AMENDMENT OF LEASES COUNTY OF CALDWELL KNOW ALL PERSONS BY THESE PRESENTS: Whereas, by execution of a lease agreement on September 9, 1980, subsequently amended on September 9, 1985, October 15, 1985, and January 23, 1989, the City of San Marcos, Texas, hereinafter referred to as IILESSORII did enter into an agreement for the lease of a portion of the San Marcos Municipal Airport, hereinafter II Airport II, to GT+3 Flight Operations, Inc., hereinafter referred to as "LESSEE", for the conduct of its business as a Fixed Base Operator at said airport; and, Whereas, by execution of a lease agreement on January 10, 1984, subsequently amended on June 11, 1985 and October 15, 1985, LESSOR did enter into an agreement for the lease of a portion of said Airport to LESSEE for its construction of, and use as, an aircraft storage hangar and parking area and for securing airplanes and for office, maintenance and repair space; and, ~'I]hereas, the parties to the above-referenced leases desire to consolidate and amend said lease agreements; now, therefore, WITNESSETH, LESSOR and LESSEE do hereby agree as follows: I. A. Premises Leased for FBO Operation. LESSOR does by these presents lease and demise unto LESSEE a portion of the San Marcos Municipal Airport situated in Caldwell County, of which LESSOR is owner by virtue of an indenture from the United States of America dated the 14th day of February, 1966, the 14th day of July, 1969, and the lIth day of May, 1976, to which reference is he reby made and by such reference, made a part thereof, said portion designated as Tracts A-I and A-2, hereinafter lithe demised premises", as shown on the attached Exhibit 1 for its conduct as a fixed base operator, hereinafter IIFBOII, at Airport.
