<br /> 112 <br /> RESOLUTION 1989-72R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF A PROPOSED MAINTENANCE AGREEMENT <br /> BETHEEN THE CITY OF SAN MARCOS AND SOUTffilEST <br /> TEXAS STATE UNIVERSITY FOR THE MAINTENANCE OF <br /> A PRACTICE ATHLETIC FIELD OHNED BY SAID CITY~ <br /> AUTHORIZ ING THE P A Y1-1ENT OF $12,ØØØ.Øø BY SAID <br /> CITY TO SOUTffilEST TEXAS STATE UNIVERSITY FOR <br /> THE PROVISION OF SAID MAINTENANCE: APPROVING <br /> THE EXECUTION OF SAID AGREEMENT BY THE CITY <br /> MANAGER; AND DECLARING AN EFFECTIVE DATE. <br />HHEREAS, on Hay 16, 1983, the City of San Marcos entered into a <br />license agreement with Southwest Texas State University for their <br />use of park property owned by the City as a practice athletic <br />field; and, <br />HHEREAS, Southwest Texas State University has entered into an <br />agreement to allow the Houston Oiler football team to use said <br />practice field during their summer training camps in 1989 and <br />199Ø; and, <br />HHEREAS, the City Council desires to enter into an agreement with <br />Southwest Texas State University for the maintenance and care of <br />said practice field by Southwest Texas State University: now, <br />therefore, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN :MARCOS, <br />TEXAS: <br />PART 1. That the terms and conditions of a proposed maintenance <br />agreement between the City of San Marcos and Southwest Texas State <br />University, for the maintenance of a practice athletic field owned <br />by said City, a copy of which is attached hereto and incorporated <br />herein for all purposes, are hereby approved. <br />PART 2. That the City Manager, Larry D. Gilley, be, and he is <br />hereby authorized to execute said maintenance agreement on behalf <br />of said City. <br />PART 3. That the expenditure of $12,ØØØ.Øø in accordance with tile <br />terms and conditions of said agreement is hereby authorized and <br />approved. <br />PART 4.
