<br /> -14- <br /> benefits of, or be otherwise subjected to discrimination in the <br /> use of the leased premises, (2) that in the construction of any <br /> improvements, on, over, or under such leased premises and the <br /> furnishing of services thereon, no person on the grounds of race, <br /> color, sex or national origin shall be excluded from participation <br /> in, denied the benefits of, or otherwise be subjected to <br /> discrimination, ( 3) that the LESSEE shall use the premises in <br /> compliance with all other requirements imposed by or pursuant <br /> to 49 CFR Part 21, Nondiscrimination in Federally Assisted <br /> Programs of the Department of Transportation, and as said <br /> Regulations may be amended. <br /> XVI. <br /> LESSOR represents and warrants that LESSOR has full right and <br /> lawful authority to enter into and perform LESSOR'S obligations <br /> under this Agreement for the full term of this Agreement and has <br /> title to said leased premises as shown by the indenture between the <br /> United States of America and LESSOR. <br /> XVII. <br /> LESSOR further covenants that if LESSEE shall discharge the <br /> obligations herein set forth to be performed by LESSEE and shall comply <br /> with all applicable local, state and federal laws, rules and <br /> regulations, LESSEE shall have and enjoy during the term hereof, <br /> quiet and undisturbed possession of said leased premises and all <br /> appurtenances appertaining thereto; provided, however, that this <br /> Agreement is subject to the prior approval of the Federal Aviation <br /> Administration, and the United States of America to take a portion of <br /> said Airport for air traffic control activities, weather reporting <br /> activities and/or communication activities related to air traffic <br /> control, all as provided in said indenture, and in such event, the <br /> provisions of this Agreement, insofar as they are inconsistent with <br /> such rights of the United States of America, and the Federal <br /> Aviation Administration, shall be suspended. Further, this <br /> Agreement shall be subordinate to the provisions of any existing <br /> or future agreement between LESSOR and the United States of America <br />
