<br /> XI. <br /> The data gathered in the appraisal process (except data furnished by <br /> Client) and the appraisal report prepared pursuant to this Agreement will <br /> remain the property of the Appraiser. With respect to the data provided by <br /> Client, Appraiser shall not violate the confidential information furnished <br /> to Appraiser. Appraiser is, however, authorized by Client to disclose all <br /> or any portion of the appraisal report and the related appraisal data to <br /> appropriate representatives of the American Institute of Real Estate <br /> Appraisers and Society of Real Estate Appraisers if such disclosure is <br /> required to enable Appraiser to comply with the By-laws and Regulations of <br /> such Institute and Society now or hereafter in effect. <br /> XII. <br /> This agreement represents the entire Agreement between Client and Appraiser <br /> and supersedes all prior negotiations, representations, or agreements, <br /> either written or oral. <br /> This agreement may be terminated by either party upon five (5) days prior <br /> written notice. In such event, Appraiser shall be paid for all services <br /> actually performed in accordance with this agreement prior to the <br /> termination date. <br /> If the project is suspended or abandoned in whole or in part for more than <br /> six (6) weeks, Appraiser shall be compensated for all services performed <br /> prior to receipt of written notice from Client of such suspension or <br /> abandonment. If the project is then resumed after being suspended for more <br /> than six (6) weeks, Appraiser's compensation shall be subject to <br /> renegotiation. <br /> XIII. <br /> Any notices required by the terms of this agreement shall be addressed to <br /> the following: <br /> To Austin Valuation Consultants, Inc.: <br /> Rudy R. Robinson <br /> 3600 Bee Cave Road, Suite 200 <br /> Austin, TX 78746 <br /> To City of San Marcos: <br /> Larry Gilley, City Manager <br /> 630 East Hopkins <br /> San Marcos, TX 78666 <br /> XIV. <br /> This agreement shall be binding upon the heirs, successors and assigns of <br /> Client and Appraiser. <br />
