<br />AN ORDINANCE OF THE~ CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY ZONING LOTS 3 AND 4, OUT OF THE COERS
<br />SUBDIVISION, A SUBDIVISION OUT OF THE T.J. CHAMBERS
<br />SURVEY, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 137,
<br />PAGE 231 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT
<br />460 WEST HOLLAND STREET FROM "R-l" (SINGLE FAMILY
<br />DWELLING DISTRICT-LOW DENSITY) TO "OP" (OFFICE-
<br />PROFESSIONAL DISTRICT) AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on February 21,1989, the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to change the zoning from "R-l" (Single-Family
<br />Dwelling District-Low Density) to "OP" (Office-Professional District)
<br />for Lots 3 and 4, out of the Coers Subdivision, a Subdivision out
<br />of the T.J. Chambers Survey, to the City of San Marcos, Hays
<br />County, Texas; 10cated at 460 West Holland Street; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Zoning Commission did, on February 21, 1989, consider said request and
<br />voted to approve the same and has recommended that such
<br />request be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 28 day
<br />of Auqust , 1989, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described real property 10cated in
<br />San Marcos, Hays County, Texas, which is presently zoned "R-l"
<br />(Single Family Dwelling District-Low Density) be rezoned to "OP"
<br />(Office-Professional District):
<br />
<br />LOTS 3 AND 4, OUT OF THE COERS SUBDIVISION, A SUBDIVISION
<br />OUT OF THE T.J. CHAMBERS SURVEY, HAYS COUNTY, TEXAS, AS
<br />RECORDED IN VOLUME 137, PAGE 231 OF THE HAYS COUNTY DEED
<br />RECORDS.

<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on September 11, 1989, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shal1 not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shal1 be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED thi s 28 day of August, 1989,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for September II, 1989 .
