<br /> 147 <br /> This AGREEMENT is made this the 29 day of August , <br /> <br /> 1989 between the CITY OF SAN MARCOS, TEXAS, hereinafter referred to <br /> as "OWNER', 630 East Hopkins, San Marcos, Texas 78666, and <br /> McCULLEY, FRICK AND GILMAN, INC., 5818 Balcones Drive, Suite 202, <br /> Austin, Texas, 78731, hereinafter referred to as "CONSULTANT", for <br /> hydrogeological, hydrological, geochemical, and environmental <br /> services in connection with the Municipal Landfill Ground Water <br /> Assessment. <br /> WITNESSETH: Owner and Consultant do hereby agree as follows: <br /> ARTICLE 1 <br /> CONSULTANT'S SERVICES AND RESPONSIBILITIES <br /> Consultant shall be responsible for the proper, accurate and <br /> adequate: <br /> development of a ground water monitoring system that <br /> addresses Texas Department of Health requirements for location, <br /> construction, sampling and analysis within the scope of the Texas <br /> Department of Health acceptance of the plan dated June 26, 1989, as <br /> subsequently revised. <br /> evaluation of the hydrogeology of the landfill site and <br /> adjacent areas to assess the occurence, quality and movement of <br /> ground water; and <br /> assessment of the possible sources of ground water <br /> contaminants detected in on-site and off-site wells. <br /> Consultant may be required to attend. public meetings or <br /> administrative agency meetings in order to make formal <br /> presentations of the alternatives, costs, results and other <br /> relative issues. <br /> -1- <br />
