<br /> 183 <br /> CITY OF SAN MARCOS <br /> RESOLUTION NO. 1989-99R <br /> STATE OF TEXAS <br /> A RESOLUTION AUTHORIZING INITIATION OF CONDEMNATION <br /> PROCEEDINGS TO ACQUIRE A 0.96, 0.55, AND 0.61 <br /> ACRE PUBLIC UTILITY EASEMENTS IN CONNECTION WITH <br /> WATER AND WASTEWATER PIPELINE IMPROVEMENTS IN THE <br /> CITY OF SAN MARCOS <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that certain water and wastewater pipeline <br /> improvements are required for the preservation of the public <br /> health, safety and welfare and the public convenience and <br /> necessity in the city of San Marcos, Texas; and <br /> WHEREAS, the necessary improvements require acquisition by <br /> the City of a 0.96, 0.55, and 0.61 acre public utility easements <br /> as more fully described in Exhibits A, B, and C attached hereto <br /> and incorporated herein for all purposes; and <br /> WHEREAS, the City of San Marcos has previously attempted to <br /> negotiate in good faith for the purchase of said public utility <br /> easements; and <br /> WHEREAS, the City of San Marcos has been unable to acquire <br /> said easements by purchase notwithstanding said negotiations; <br /> THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> San Marcos, Texas, as follows: <br /> 1. That the 0.96, 0.55, and 0.61 acre tracts more fully <br /> described in Exhibits A, B, and C attached hereto and <br /> incorporated herein for all purposes is necessary and essential <br /> for the completion of water and wastewater improvements in the <br /> City of San Marcos; <br />
