15 EXHIBIT "A" STATE OF TEXAS CONTRACT FOR SERVICES COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Kathy M. Morris, by Resolution duly adopted on September 25, 1989, hereinafter "City," and the San Marcos Chamber of Commerce, hereinafter "Chamber," acting by and through its Executive Vice-President, Jim Gandy, enter into this Agreement pursuant to the terms and provisions of Chapter 26, Article II, of the Code of Ordinances of the City of San Marcos, Texas, and Chapter 351, Tax Code, V.T.C.A. WITNESSETH I. That City has enacted by ordinance a hotel room occupancy tax to be levied upon the occupancy of any room furnished by any hotel or motel within City. Pursuant to Section 26-21 of the Code of Ordinances of City, "Use of Proceeds", City does hereby agree to allocate funds from the revenue of said tax to Chamber. The allocation of funds to Chamber is hereby agreed to be five sevenths (5/7) of the gross of all funds collected and received by the City from the hotel room occupancy tax. Furthermore, it is expressly agreed that Chamber shall be entitled to operating and administrative expenses incurred in fulfilling Chamber's responsibilities under this Agreement. Said operating and administrative expenses shall not exceed fifteen percent (15%) of the total allocation of such funds collected from the hotel room occupancy tax and received by Chamber. II. Chamber hereby agrees to expend said funds for the activities set out in Section 26-21 of the Ordinance. Those activities shall include general promotional and tourist advertising for the City of San Marcos and its vicinity and conducting a solicitation and operating program to attract conventions and visitors to the City.
