<br />15 <br /> <br /> <br />EXHIBIT "A" <br /> <br /> <br /> <br />STATE OF TEXAS <br />CONTRACT FOR SERVICES <br />COUNTY OF HAYS <br /> <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br /> <br />existing by and under the laws of the State of Texas, acting through <br /> <br />authority conferred on its Mayor, Kathy M. Morris, by Resolution duly <br /> <br />adopted on September 25, 1989, hereinafter "City," and the San <br /> <br />Marcos Chamber of Commerce, hereinafter "Chamber," acting by and <br /> <br />through its Executive Vice-President, Jim Gandy, enter into this <br /> <br />Agreement pursuant to the terms and provisions of Chapter 26, <br /> <br /> <br />Article II, of the Code of Ordinances of the City of San <br /> <br /> <br />Marcos, Texas, and Chapter 351, Tax Code, V.T.C.A. <br /> <br />WITNESSETH <br /> <br /> <br />I. <br /> <br /> <br />That City has enacted by ordinance a hotel room occupancy tax to <br /> <br /> <br />be levied upon the occupancy of any room furnished by any hotel or <br /> <br /> <br />motel within City. Pursuant to Section 26-21 of the Code of <br /> <br /> <br />Ordinances of City, "Use of Proceeds", City does hereby agree to <br /> <br /> <br />allocate funds from the revenue of said tax to Chamber. The <br /> <br /> <br />allocation of funds to Chamber is hereby agreed to be <br /> <br />five sevenths (5/7) of the gross of all funds collected and <br /> <br /> <br />received by the City from the hotel room occupancy tax. Furthermore, <br /> <br /> <br />it is expressly agreed that Chamber shall be entitled to <br /> <br /> <br />operating and administrative expenses incurred in fulfilling <br /> <br /> <br />Chamber's responsibilities under this Agreement. Said <br /> <br /> <br />operating and administrative expenses shall not exceed fifteen <br /> <br />percent (15%) of the total allocation of such funds collected from <br /> <br /> <br />the hotel room occupancy tax and received by Chamber. <br /> <br />II. <br /> <br /> <br />Chamber hereby agrees to expend said funds for the activities set <br /> <br /> <br />out in Section 26-21 of the Ordinance. Those activities shall include <br /> <br /> <br />general promotional and tourist advertising for the City of San <br /> <br />Marcos and its vicinity and conducting a solicitation and <br /> <br /> <br />operating program to attract conventions and visitors to the City. <br /> <br /> <br />Chamber further agrees to make such expenditures in conformance with <br />
