<br />(1) Sell, convey, lease, mortgage or otherwise alienate any land which is now, or shall <br />hereafter be, dedicated for park purposes, unless the qualified voters of the city shall <br />authorize such act by adopting in a general or special election a proposition <br />submitting the question and setting forth the terms and conditions under which such <br />sale, conveyance, lease, mortgage or other alienation is to be made; provided, that the <br />city council may, after a public hearing, authorize a lease of park property to another <br />governmental entity or to a non-profit corporation or association for a term of up to <br />three years if the council determines that the lease will further the use of the property <br />for park purposes. <br /> <br />(2) Sell, convey, or lease all or any substantial part of the facilities of any municipally <br />owned public utility, provided that the council may lease all or a substantial part of <br />such facilities to any public agency of the State of Texas if the qualified voters of the <br />city authorize such lease by adopting in a general or special election a proposition <br />submitting the question and setting forth the terms and conditions under which such <br />lease is to be made. <br /> <br />(3) Accept or admit liability in, or pay, any claim for damages asserted against the city, <br />without first obtaining a written opinion from the city attorney regarding the city's <br />liability therein. <br /> <br />(c) The council will have the authority to approve the conveyance of land, right-of-way <br />and easements owned by the city. Any such approval will be in the form of an ordinance, <br />and no such ordinance may be adopted as an emergency measure. <br /> <br />MEASURE NO. 6 <br /> <br />SHALL SECTION 3.09 OF THE CITY CHARTER BE AMENDED TO READ AS <br />FOLLOWS: <br /> <br />Sec. 3.09. Meetings of the city council. <br /> <br />The city council shall hold at least two regular meetings in each month at a time to be <br />fixed by it for such regular meetings, and may hold as many additional meetings during the <br />month as may be necessary for the transaction of the business of the city and its citizens. All <br />meetings of the city council shall be held within the city, except that the city council may <br />conduct a meeting at a location outside the city after publishing notice of the meeting in one <br />issue of a newspaper in general circulation in the City of San Marcos. All meetings of the <br />city council shall be public; however the council may recess for the purpose of discussing <br />in a closed session any matter permitted to be so discussed by state law, provided that the <br />general subject matter for consideration is expressed in the motion calling for such a session <br />and that final action thereon shall not be taken by the council until the matter is placed on the <br />agenda. Special meetings of the council shall be called by the city secretary upon the written <br />request of the mayor or any three members of the city council. <br /> <br />The city council shall provide by ordinance for procedures to call meetings, set meeting <br />agendas, conduct meetings, provide for reasonable time limits on presentations to the council <br />and any other matters necessary to the efficient and fair conduct of the public's business. <br /> <br />MEASURE NO.7 <br /> <br />SHALL SECTION 3.17 OF THE CITY CHARTER BE AMENDED TO READ AS <br />FOLLOWS: <br /> <br />Sec. 3.17. Expulsion or removal of city officials. <br /> <br />(a) The city council shall have the authority to expel any city council member who is <br />absent three consecutive regular city council meetings unless the council member has secured <br />permission, in advance, from the city council to be absent from at least one of the meetings; <br /> <br />-4- <br />
