<br />73 <br />RESOLUTION 1989-119R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE CITY'S ONE-YEAR <br />PARTICIPATION IN PURCHASING PROGRAMS OF THE STATE <br />PURCHASING k~D GENERAL SERVICES COMMISSION FOR THE <br />ACQUISITION OF CERTAIN PRODUCTS AND MATERIALS ON <br />THE COMMISSION'S ANNUAL CONTRACTS FOR SUCH ITEMS, <br />AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN <br />AND DELIVER ALL NECESSARY REQUESTS AND OTHER <br />DOCUMENTS IN CONNECTION THEREWITH, DIRECTING THAT <br />ALL DECISIONS OF THE CITY MANAGER RELATING TO THE <br />PURCHASING PROGRAMS SHALL BE AS DIRECTED BY THE <br />CITY COUNCIL, PROVIDING THAT THE CITY WILL PURCHASE <br />SUCH ITEMS FROM THE CONTRACTS MADE PURSUANT TO THIS <br />RESOLUTION BY SUBCHAPTER D, SECTIONS <br />(271.Ø81-271.Ø83), VERNON'S ANNOTATED TEXAS LOCAL <br />GOVERNMENT CODE, EXCEPT IN EMERGENCIES, AND THAT <br />THE CITY WILL BE RESPONSIBLE FOR PAYMENT DIRECTLY <br />TO THE VENDOR UNDER EACH SUCH CONTRACT AND WILL BE <br />RESPONSIBLE FOR THE VENDOR'S COMPLIANCE WITH ALL <br />CONDITIONS OF DELIVERY AND QUALITY OF PURCHASED <br />ITEMS, AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />WHEREAS, the City of San Marcos, Texas pursuant to the authority <br />granted by Subchapter D, Sections (271.Ø81-271.Ø83), Vernon's <br />Annotated Texas Local Government Code, as amended, desires to <br />participate in certain below-described purchasing programs of the <br />State Purchasing and General Services Commission; and <br /> <br />WHEREAS, the City Council of the City is of the opinion that <br />participation in these programs will be highly beneficial to the <br />taxpayers of this City through the anticipated savings to be <br />realized; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the City of San Marcos, Texas, does hereby request <br />the State Purchasing and General Services Commission to include the <br />City's stated need for the following contract class numbers as <br />follows: <br /> <br />Ø7Ø - Automobiles and Light Duty trucks <br /> <br />PART 2. That the City's participation in such purchasing <br />programs of the State Purchasing and General Services Commission for <br />the acquisition of such items is hereby authorized~ <br /> <br />PART 3. That the City Manager is hereby authorized and directed <br />to sign and deliver all necessary requests and other documents in <br />connection therewith for and on behalf of the City. <br /> <br />PART 4. That all decisions of the City Manager relating to <br />these purchasing programs will be directed by the City Council. <br /> <br />PART 5. That the City of San Marcos, Texas, will purchase the <br />items from the contracts made pursuant to this Resolution and <br />(Subchapter D, Sections 271. Ø81-271. Ø83), Vernon's Annotated Texas <br />Local Government Code, except in emergencies, and will be responsible <br />for payment directly to the vendor under each such contract and will <br />be responsible for the vendor's compliance with all conditions of <br />delivery and quality of purchased items. <br /> <br />PART 6.
