<br /> 77 <br /> Hays County <br /> I.H. 35 <br /> STATE OF TEXAS § <br /> § <br /> COUNTY OF TRAVIS § <br /> AGREEMENT BETWEEN <br /> THE STATE OF TEXAS <br /> AND <br /> THE CITY OF SAN MARCOS, TEXAS <br /> FOR THE CONSTRUCTION OF ADDITIONAL DRAINAGE <br /> FACILITIES ALONG AND ACROSS THE EAST FRONTAGE ROAD OF I.H. 35 <br /> NEAR YARRINGTON ROAD IN THE CITY <br /> OF SAN MARCOS, TEXAS <br /> THIS AGREEMENT, entered into this 1st day of November , 1989 <br /> by and between the State of Texas, hereinafter called the IIStateli represented by <br /> the state Engineer-Director of the State Department of Highways and Publ i c <br /> Transportation, acting for and in behalf of the state Department of Highways and <br /> publ i c Transportation Cornnission, and the Ci ty of San Marcos, Texas, a loca 1 <br /> government, hereinafter ca 11 ed the IICityll, acting by and through its duly <br /> authorized officers. <br /> WIT N E SSE T H <br /> WHEREAS, the state owns, operates, and maintains a system of highways for public <br /> use and benefit, including I.H. 35 in the Ci ty of San Marcos, Hays County, <br /> Texas; and <br /> WHEREAS, the City desires and has requested authority from the state to <br /> construct or to have constructed additional drainage facilities along and across <br /> the I. H. 35 east frontage road, hereinafter ca 11 ed the IIproject II, at the <br /> approximate location shown on construction drawings, hereinafter indentified as <br /> IIExhibit All, attached hereto and made a part of this agreement. <br /> WHEREAS, the City has agreed to assume all costs associated with the design and <br /> construction of the proposed drainage facilities, and <br /> WHEREAS, on the 23rd day of October , 19 8 9 , the San Marcos <br /> City Council passed Resolution No. , attached hereto and inden- <br /> tified as IIExhi bit BII, author i Zl ng the Clty to enter into any necessary <br /> agreements with the state for the purposes of constructing the proposed drainage <br /> facilities within the State IS I.H. 35 right-of-way; and <br /> WHEREAS, pursuant to Article 6673b, V.T.C.S., the State is authorized to enter <br /> into agreements with cities in Texas for the purposes of constructing and <br /> operating State Highway facilities and incidentals thereto within the cities <br /> incorporated limits; <br /> Page 1 of 5 <br /> 11/89 <br />
