<br /> 83 <br /> RESOLUTION 1989-123 <br /> A RF'~OLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN <br /> (MAP) OF THE MASTER PLAN OF SAID CITY, BEING .718 ACRES, <br /> MORE OR LESS, OF LAND AREA OUT OF THE J.M. VERAMENDI <br /> SURVEY NO. 1 ALSO BEING A PART OF A 2.19 ACRE PARCEL <br /> DESCRIBED AS TRACT NO. 1 IN VOLUME 231, PAGE 149, HAYS <br /> COUNTY, DEED RECORDS, A/K/A FARMERS GIN/BARSOTTI'S FROM <br /> LOvJ DENS ITY RESIDENTIAL TO COMMERCIAL AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, on October 17, 1989, the Joint Planning and Zoning <br />Commissions of the City of San Marcos held a public hearing regarding <br />a request to amend the Future Land Use Plan (Map) of the Master <br />Plan from Low Density Residential to Commercial of .718 acres, more <br />or less, out of the J.M. Veramendi Survey No. 1, Hays County, Texas; <br />and, <br /> WHEREAS, subsequent to said public hearing on said date, said <br />Commissions did, on October 17, 1989, consider said request and <br />voted to approve the same and have recommended that such <br />request be approved by the City Council of said City; and, <br /> WHEREAS, said City Council held a public hearing on the 30 day <br />of October , 1989, regarding such request; and, <br /> l';¡HEREAS, all requirements of the Master Plan pertaining to <br />amendments have been met; and, <br /> WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following resolution is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. That the following described tract of real property <br />fronting on the Southeast Right-Of-Way Line of Interstate Highway 35, <br />San Marcos, Hays County, Texas, which is in an area shown on the <br />Future Land Use Plan (Map) of the Master Plan of the City of San <br />Marcos as Low Density Residential shall be shown on said map as <br />Commercial: <br /> TRACT I: .718 acres of land out of the J.M. Veramendi Survey <br /> No. 1, also being part of a 2.19 acre parcel described as Tract <br /> No. 1 in Volume 231, p ag e 1 4 9, Hays County, Texas Deed Records <br /> and more particularly described as follows: <br /> Commencing at an iron pipe driven in the North Street line of <br /> Grove Street that bears S 81 degrees 15' W a distance of <br /> 209.311 from the intersection of the North street line of Grove <br /> Street and the West street line of Guadalupe Street. <br /> THENCE continuing along the North street line of Grove Street <br /> on a bearing of S 81 degrees IS' W a distance of 333.98' to an <br /> iron stake. <br /> THENCE S 83 degrees 00' W, a distance of 49.17' to an iron <br /> stake, said iron stake marking the intersection of the North <br /> street line of Grove Street and the Southeast R.O.N. line <br /> of the Missouri, Kansas, and Texas Railroad Company and being <br /> the most Western corner of the property herein described. <br /> THENCE along the Southeast R.O.N. line of the Missouri, Kansas <br /> and Texas Railroad Company on a bearing of N 53 degrees 00' E a <br /> distance of 339.94' to an iron stake. At the 178.2' point, on <br /> this bearing, the corner of the Northwest wall of a warehouse <br /> building will be encountered. The Northwest wall of the <br /> warehouse is co-linear with the Southeast R.O.W. line of the <br /> Missouri, Kansas, and Texas Railroad Company. <br /> THENCE on a bearing of S 36 degrees DO' 29" E, a distance of <br /> 182.681 to an iron pipe in the North street line of Grove <br /> Street, said iron pipe also being the point of beginning. <br />
