<br />AN OPDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY ZONING PREVIOUSLY UNZONED PROPERTY TO A
<br />ZONING DESIGNATION OF "LI" (LIGHT INDUSTRIAL DISTRICT),
<br />BEING 110.859 ACRES, MORE OR LESS, OF LAND AREA
<br />COMPRISED OF APPROXIMATELY 17.099 ACRES OUT OF THE
<br />WILLIAM WARD LEAGUE, SURVEY NO.3, ABSTRACT 467 AND
<br />APPROXIMATELY 93.76 ACRES OUT OF THE JOEL MINER SURVEY,
<br />ABSTRACT 321, HAYS COUNTY, TEXAS, SAID 110.859 ACRES OF
<br />LAND BEING 12.843 ACRES OUT OF A PORTION OF THE LAND
<br />CONVEYED BY KITTY P. YARRINGTON TO JOHN T. YARRINGTON

<br />HAYS COUNTY, TEXAS, SAID 110.859 ACRES OF LAND ALSO BEING
<br />87.232 ACRES OUT OF THE ARCHIE M. YARRINGTON 93.95 ACRE
<br />FOURTH TRACT AND 10.784 ACRES OUT OF THE ROBERT C.
<br />YARRINGTON 111.64 ACRE THIRD TRACT OUT OF A DIVISION OF THE
<br />YARRINGTON ESTATE BY DEED DATED JULY 25, 1942 RECORDED IN
<br />VOLUHE 125, PAGE 70 Of THE DEED RECORDS, HAYS COUNTY, TEXAS,
<br />AND FRONTING ON THE SOUTHEAST RIGHT-OF-WAY LINE OF
<br />INTERSTATE HIGHWAY 35 A/K/A COMPOSITE TECHNOLOGY ENGINE
<br />COMPONENTS; AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on September 19, 1989, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to
<br />zone previously unzoned property to a zoning designation of "LI"
<br />(Light Industrial District), being 110.859 acres, more or less of
<br />land fronting on the Southeast Right-of-Way Line of Interstate
<br />Highway 35 in the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on September 19,1989, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 30 day
<br />of October, 1989, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />Unzoned henceforth shall be zoned "LI" (Light Industrial District):

<br />Being 110.859 Acres of Land and comprised of approximately
<br />17.099 Acres out of the William Ward League, Survey No.3,
<br />Abstract 467 and approximately 93.76 acres out of the Joel
<br />Miner Survey, Abstract 321, Hays County, Texas, said 110.859
<br />acres of land being 12.843 acres out of a portion of the land
<br />conveyed by Kitty P. Yarrington to John T. Yarrington by deed
<br />dated November 9, 1942 recorded in Volume 125, Page 543 and a
<br />portion of the land conveyed by Arabella C. Yarrington to John
<br />T. Yarrington by deed dated November 9, 1942 recorded in Volume
<br />125, Page 541 of the Deed Records, Hays County, Texas, said
<br />110.859 acres of land also being 87.232 acres out of the Archie
<br />M. Yarrington 93.95 acre Fourth Tract and 10.784 acres out of
<br />the Robert-C. Yarrington 111.64 acre Third Tract out of a
