<br /> -5- <br /> The total sum payable to Consultant shall not exceed the sum of <br /> $21,300.00 without the prior written authorization of the Ci ty <br /> Manager of City. <br /> 5. Project Management <br /> Mr. Benjamin Jones will be the project manager and principal <br /> scientist assigned to this project. He will provide the technical <br /> consulting support and industry interface. He will be assisted by <br /> his employees who will take samples and coordinate analyses. <br /> The Consultant represents that he has, or will secure at his own <br /> expense, all personnel required for the performance of services <br /> under this Contract. Such personnel shall not be employees of <br /> or have any contractual relationship with the City. All of the <br /> services required hereunder will be performed by the Consultant or <br /> under his supervision, and all personnel engaged in the work <br /> shall be fully qualified to perform such services. The Consultant <br /> shall commence, carry out and complete the project in accordance <br /> with all applicable laws of the City of San Marcos and the Sta te <br /> of Texas. <br /> 6. Services and Materials to be Furnished by City <br /> The City shall furnish the Consultant \\1 i th all available <br /> necessary information, data, and materials pertinent to the <br /> execution of this contract. The City shall cooperate with <br /> the Consultant in carrying out the work herein. <br /> 7. Termination of Contract for Cause <br /> If, through any cause, the Consultant or the City shall fail to <br /> fulfill in a timely and proper manner obligations under this <br /> contract, either party shall thereupon have the right to <br />
