<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984,
<br />(VOLUME 66) BY CHANGING THE PLANNED UNIT DEVELOPMENT
<br />ZONING BY REVISING A P.U.D. DEVELOPMENT PLAN FOR BLOCK
<br />A, LOTS 1-27 AND BLOCK B, LOTS 1-26 OF THE PARKLANE
<br />GARDEN HOMES SUBDIVISION, PHASE I, RECORDED IN VOLUME
<br />5, PAGE 75, HAYS COUNTY PLAT RECORDS, AND BLOCK
<br />A, LOTS 28-75 AND BLOCK B, LOTS 27-68 OF THE SUNRIDGE
<br />P.U.D. RECORDED IN VOLUME 4, PAGES 309-311, HAYS COUNTY
<br />PLAT RECORDS, WHICH TOGETHER WITH STREET RIGHT-OF-WAY
<br />DEDICATED THEREIN CONSISTS OF A TOTAL OF 26.49 ACRES OF
<br />LAND MORE OR LESS, A/K/A PARKLANE GARDEN HOMES; AND
<br />DECLARING AN EFFECTIVE DAT&.

<br />WHEREAS, on September 12, 1988, the City Council of the City of
<br />San Marcos held a public hearing regarding a request to approve a
<br />revised P.U.D. Development Plpn for Parklane Garden Homes consisting of
<br />a 26.49 acre tract of land located on the westside of Bishop Street at
<br />Lancaster Street, said tract being located in San Marcos, Hays County,
<br />Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, the City
<br />Council did on September 26,1988, consider the request and voted to
<br />approve the same; and,
<br />
<br />WHEREAS, on July 18, 1989, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to approve a
<br />revised P.U.D. Development Plan for Parklane Garden Homes; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, the
<br />Zoning Commisison voted to approve the same and has recommended that
<br />the request be approved by the City CQuncil; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the
<br />29 day of November, 1989, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning ordinance,
<br />of the Code of Ordinances of the City of San Marcos pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That the Zoning Commission's approval of the Parklane
<br />Garden Homes Planned Unit Development Plan described in Exhibit "A"
<br />which is attached hereto and incorporated herein for all purposes is
<br />hereby approved for Block A, Lots 1-27 and Block B, Lots 1-26 of the
<br />Parklane Garden Homes Subdivision, as recorded in Volume 5, Page 75,
<br />Hays County Plat Records and Block A, Lots 28-75 and Block B, Lots
<br />27-68 of the Sunridge P.U.D. recorded in Volume 4, Pages 309-311, Hays
<br />County Plat Records, which together with street right-of-way
<br />dedicated therein consists of a total of 26.49 acres of land more or
<br />less, a/k/a Parklane Garden Homes.

<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on December 4, 1989, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this the 29 day of November, 1989 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for December 4, 1989.
