<br /> -3- <br /> SECTION 9. Compliance With Laws. PHS agrees to comply with all <br /> apD1icab1e laws~ ordinances, codes and regulations of the local, state <br /> and federal governments including but not limited to those laws, <br /> oniinances, codes and regulations pertaining to equal employment <br /> oppor-tunity and those pertaining to discrimination against <br /> ¡Jar-ticipants. With respect to the requirement of State Law that a <br /> contr-act for human services to the indigent entered into he tween a <br /> City aild a social services organization may not provide for more than <br /> 5n~ 'Jf the annual budget of the organization to be derived from <br /> C i t'l funds, PHS declares that at the time of the execution of this <br /> ag n~e'ìen t, funds to be provided hereunder do not exceed 50% of the <br /> annual ~udget of PHS. In the event that such funds do exceed 50% of <br /> the 1nn.uë\1 budget of PHS at any time during which this contract is <br /> in effect, PHS ag rees to notify City immediately so that appropriate <br /> T'lOnet1e'l 3djustments to this contract can be made to assure compliance <br /> with ::;t:.ate Law. <br /> -òF:CTION 10. Breach Of Contract. <br /> ~. If the City Manager of the City determines that the activities <br /> 3S described in the human services funding application <br /> attached hereto are not being carried out as approved <br /> hy the City or that PHS is in hreach of any of the terms of <br /> this agreement, the City Manager shall notify PHS in writing <br /> of the deficiency. PHS shall have ten (10) working days from <br /> the date of the notice to correct or satisfy the deficiency. <br /> :j. If the deficiency is not appropriately corrected or satisfieci <br /> in the opinion of the City Manager within the prescribed <br /> time, notice may be given to PHS that its funding will be <br /> terminated. <br /> C. ,'\ decision to te r¡¡1i na te funding may he appealed to the City's <br /> Human Services Advisory Board within ten days of the date of <br /> the notice to terminate funding. During the appeal process, <br /> funding to PHS shall continue. <br />
