-3- SECTION 9. Compliance With Laws. PHS agrees to comply with all apD1icab1e laws~ ordinances, codes and regulations of the local, state and federal governments including but not limited to those laws, oniinances, codes and regulations pertaining to equal employment oppor-tunity and those pertaining to discrimination against ¡Jar-ticipants. With respect to the requirement of State Law that a contr-act for human services to the indigent entered into he tween a City aild a social services organization may not provide for more than 5n~ 'Jf the annual budget of the organization to be derived from C i t'l funds, PHS declares that at the time of the execution of this ag n~e'ìen t, funds to be provided hereunder do not exceed 50% of the annual ~udget of PHS. In the event that such funds do exceed 50% of the 1nn.uë\1 budget of PHS at any time during which this contract is in effect, PHS ag rees to notify City immediately so that appropriate T'lOnet1e'l 3djustments to this contract can be made to assure compliance with ::;t:.ate Law. -òF:CTION 10. Breach Of Contract. ~. If the City Manager of the City determines that the activities 3S described in the human services funding application attached hereto are not being carried out as approved hy the City or that PHS is in hreach of any of the terms of this agreement, the City Manager shall notify PHS in writing of the deficiency. PHS shall have ten (10) working days from the date of the notice to correct or satisfy the deficiency. :j. If the deficiency is not appropriately corrected or satisfieci in the opinion of the City Manager within the prescribed time, notice may be given to PHS that its funding will be terminated. C. ,'\ decision to te r¡¡1i na te funding may he appealed to the City's Human Services Advisory Board within ten days of the date of the notice to terminate funding. During the appeal process, funding to PHS shall continue.
