-2- SECTION 5. Periodic Payments: Funds to be paid by the City as provided in Section 3 above shall be released to PHS in approximately equal quarterly payments beginning with October 1, 1989, and continuing with the quarters beqinning on January 1, 1990, Apr i1 1, 1990 and July 1, 1990. SECTION 6. Monitorinq Of Performance: PHS agrees to allow the City, either directly or through its Human Services Advisory Board, to inspect, at City's request, and with advance notice to PHS, all pertinent records, files, information or other written material maintained by PHS or its subcontractors and related to the subject matter of this contract. Any failure by PHS to provide such records as requested by City in a timely manner may be deemed by the City to be a breach of this contract by PHS. Notwithstanding the forego i ng requirements of this Section, the City acknowledges the need for confidentiality of client records and a'lrees that information which personally identifies individual clients will not be sought or requ ired. SECTION 7. Sub-contracts. No part of this contract may be subcontracted to any other person, corporation, entity, organization or association without the prior written consent of the Ci ty to such sub-contractor- and to the te rms and conditions of any such sub-contract. SECTION 8. Political Activity. No portion of the funds received by PHS under this contract shall be used, directly or indirectly, for any political activity including any activity to further the election or defeat of any candidate for public office or any activity undertaken to influence the passag e, defeat or- final content of legislation.
