<br /> -)- <br /> SECTION 9. Compliance With Laws. PHS agrees to comply with all <br /> applicable laws, ordinances, codes and regulations of the local, s ta'te <br /> and federal governments including but not limited to those laws, <br /> ordinances, codes and regulations pertaining to equal employment <br /> opportunity and those pertaining to discrimination against <br /> participants. With respect to the requirement of State Law that a <br /> contract for human services to the indigent entered into between a <br /> City and a social services organization may not provide for more than <br /> 50% of the annual budget of the organization to be derived from <br /> City funds, PHS declares that at the time of the execution of this <br /> 39 reemen t, funds to be provided hereunder do not exceed 50% of the <br /> annual budget of PHS. In the event that such funds do exceed 50% of <br /> the annual budget of PHS at any time during which this contract is <br /> in effect, PHS ag rees to not tfy City immediately so that appropriate <br /> monetary ~djustments to this contract can be made to assure compliance <br /> ,vi t h S ta te Law. <br /> SECTION 10. Breach Of Contract. <br /> A. If the City Manager of the City determines that the activities <br /> as described in the human services funding aDplication <br /> attached hereto are not being carried out as approved <br /> by the City or that PHS is in breach of any of the terms of <br /> this agreement, the City Manager shall notify PHS in writing <br /> of the deficiency. PHS shall have ten (l ()) working days from <br /> the date of the notice to correct or satisfy the deficiency. <br /> R. If the deficiency is not appropriately corrected or satisfierl <br /> in the opinion of the City Manager within the prescribed <br /> time, notice may be given to PHS that its funding will be <br /> terminated. <br /> C. A decision to te rmi na te funding may be appealed to the City's <br /> Human Services Advisory Board within ten days of the date or <br /> the notice to terminate fund i ng. During the appeal process, <br /> funding to PHS shall continue. <br />
